  1.1                          A bill for an act 
  1.2             relating to education; prohibiting the sale or 
  1.3             distribution of soda pop in schools; amending 
  1.4             Minnesota Statutes 2000, section 123B.02, subdivision 
  1.5             13. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  Minnesota Statutes 2000, section 123B.02, 
  1.8   subdivision 13, is amended to read: 
  1.9      Subd. 13.  [SCHOOL LUNCHES; SODA POP PROHIBITED.] The board 
  1.10  may furnish school lunches for pupils and teachers on such terms 
  1.11  as it determines.  The sale or distribution of soda pop to a 
  1.12  student in a school building or on school grounds is prohibited 
  1.13  during the school day.  Machines dispensing soda pop located in 
  1.14  areas accessible only by teachers must not be visible to 
  1.15  students.  
  1.16     [EFFECTIVE DATE.] This section is effective July 1, 2002, 
  1.17  for school districts that do not have a contract with a soda pop 
  1.18  distributor and for school districts that have a contract with a 
  1.19  soda pop distributor that expires before July 1, 2002.  For 
  1.20  school districts with contracts with a soda pop distributor that 
  1.21  do not expire by July 1, 2002, this section is effective upon 
  1.22  expiration of the contract.
