1.1 A bill for an act 1.2 relating to state government; adding members to the 1.3 designer selection board; providing the designation of 1.4 at least two designers for projects at the University 1.5 of Minnesota or the state colleges and universities; 1.6 amending Minnesota Statutes 1998, section 16B.33, 1.7 subdivisions 2 and 3a. 1.8 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 1.9 Section 1. Minnesota Statutes 1998, section 16B.33, 1.10 subdivision 2, is amended to read: 1.11 Subd. 2. [ORGANIZATION OF BOARD.] (a) [MEMBERSHIP.] The 1.12 state designer selection board consists offiveseven 1.13 individuals, the majority of whom must be Minnesota residents. 1.14 Each of the followingthreefour organizations shall nominate 1.15 one individual whose name and qualifications shall be submitted 1.16 to the commissioner of administration for consideration: the 1.17 consulting engineers council of Minnesota after consultation 1.18 with other professional engineering societies in the state; 1.19 the AIA Minnesotasociety of architects; the Minnesota chapter 1.20 of the associated general contractors after consultation with 1.21 other commercial contractor associations in the state; and the 1.22 Minnesota board of the arts. The commissioner may appoint 1.23 thethreefour named individuals to the board but may reject a 1.24 nominated individual and request another nomination. The fifth 1.25 member shall be a representative of the user agency, the 1.26 University of Minnesota, or the Minnesota state colleges and 2.1 universities, designated by the user agency. The remaining two 2.2 citizen members shall also be appointed by the commissioner. 2.3 (b) [NONVOTINGMEMBERSMEMBER.] In addition to thefive2.4 seven members of the board,twoone nonvotingmembersmember 2.5 representing the commissioner shall participate in the 2.6 interviewing and selection of designers pursuant to this 2.7 section.One shall be a representative of the commissioner and2.8shall participate in the interviewing and selection of designers2.9for all projects. The other shall be a representative of the2.10user agency, who shall participate in the interviewing and2.11selection of the designers for the project being undertaken by2.12the user agency. The commissioner shall appoint the2.13representative of the user agency in consultation with the user2.14agency.2.15 (c) [TERMS; COMPENSATION; REMOVAL; VACANCIES.] The 2.16 membership terms, compensation, removal of members, and filling 2.17 of vacancies on the board are as provided in section 15.0575. 2.18 No individual may serve for more than two consecutive terms. 2.19 (d) [OFFICERS, RULES.] At its first meeting, the board 2.20 shall elect a voting member of the board as chair. The board 2.21 shall also elect other officers necessary for the conduct of its 2.22 affairs. The board shall adopt rules governing its operations 2.23 and the conduct of its meetings. The rules shall provide for 2.24 the terms of the chair and other officers. 2.25 (e) [MEETINGS.] The board shall meet as often as is 2.26 necessary, not less than twice annually, in order to act 2.27 expeditiously on requests submitted to it for selection of 2.28 primary designers. 2.29 (f) [OFFICE, STAFF, RECORDS.] The department of 2.30 administration shall provide the board with suitable quarters to 2.31 maintain an office, hold meetings, and keep records. The 2.32 commissioner shall designate an employee of the department of 2.33 administration to serve as executive secretary to the board and 2.34 shall furnish a secretarial staff to the board as necessary for 2.35 the expeditious conduct of the board's duties and 2.36 responsibilities. 3.1 Sec. 2. Minnesota Statutes 1998, section 16B.33, 3.2 subdivision 3a, is amended to read: 3.3 Subd. 3a. [HIGHER EDUCATION PROJECTS.] (a) When the 3.4 University of Minnesota or the Minnesota state colleges and 3.5 universities undertakes a project involving construction or 3.6 major remodeling, as defined in section 16B.335, subdivision 1, 3.7 with an estimated cost greater than $2,000,000 or a planning 3.8 project with estimated fees greater than $200,000, the system 3.9 shall submit a written request for a primary designer to the 3.10 commissioner, as provided in subdivision 3. 3.11 (b) When the University of Minnesota or the Minnesota state 3.12 colleges and universities undertakes a project involving 3.13 renovation, repair, replacement, or rehabilitation, the system 3.14 office may submit a written request for a primary designer to 3.15 the commissioner as provided in subdivision 3. 3.16 (c) For projects at the University of Minnesota or the 3.17 state colleges and universities, the board shall select at least 3.18 two primary designers under subdivision 4 for recommendation to 3.19 the board of regents or the board of trustees. Meeting records 3.20 or written evaluations that document the final selection are 3.21 public records. The board of regents or the board of trustees 3.22 shall notify the commissioner of the designer selected from the 3.23 recommendations.
