  1.1                          A bill for an act 
  1.2             relating to local government; changing the authorized 
  1.3             number of members of housing and redevelopment 
  1.4             authorities; increasing a member per diem limit; 
  1.5             increasing the Washington county redevelopment 
  1.6             authority to seven members; amending Minnesota 
  1.7             Statutes 1998, sections 469.003, subdivision 5; 
  1.8             469.006, subdivisions 1 and 2; and 469.011, 
  1.9             subdivision 4. 
  1.10  BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.11     Section 1.  Minnesota Statutes 1998, section 469.003, 
  1.12  subdivision 5, is amended to read: 
  1.13     Subd. 5.  [COMMISSIONERS.] An authority shall consist 
  1.14  of five up to seven commissioners, who shall be residents of the 
  1.15  area of operation of the authority, who shall be appointed after 
  1.16  the resolution becomes finally effective.  
  1.17     Sec. 2.  Minnesota Statutes 1998, section 469.006, 
  1.18  subdivision 1, is amended to read: 
  1.19     Subdivision 1.  [COUNTY COMMISSIONERS.] When the governing 
  1.20  body of a county adopts a resolution under section 469.004, the 
  1.21  governing body shall appoint five persons or the number of 
  1.22  commissioners for the governing body, plus up to two additional 
  1.23  commissioners, as commissioners of the county authority.  The 
  1.24  membership of the commission will reflect an areawide 
  1.25  distribution on a representative basis.  The commissioners who 
  1.26  are first appointed shall be designated to serve for terms of 
  1.27  one, two, three, four, and five years respectively, from the 
  2.1   date of their appointment.  Thereafter commissioners shall be 
  2.2   appointed for a term of office of five years except that all 
  2.3   vacancies shall be filled for the unexpired term.  Persons may 
  2.4   be appointed as commissioners if they reside within the 
  2.5   boundaries or area, and are otherwise eligible for the 
  2.6   appointments under sections 469.001 to 469.047. 
  2.7      Sec. 3.  Minnesota Statutes 1998, section 469.006, 
  2.8   subdivision 2, is amended to read: 
  2.9      Subd. 2.  [MULTICOUNTY COMMISSIONERS.] The governing body 
  2.10  in the case of a county, and the mayor with the approval of the 
  2.11  governing body in the case of a city, of each political 
  2.12  subdivision included in a multicounty authority shall appoint 
  2.13  one person as a commissioner of the authority at or after the 
  2.14  time of the adoption of the resolution establishing the 
  2.15  authority. 
  2.16     In the case of a multicounty authority comprising only two 
  2.17  or three political subdivisions, the appointing authorities of 
  2.18  the participating political subdivisions shall each appoint one 
  2.19  up to two additional commissioner commissioners whose term of 
  2.20  office shall be as provided for a commissioner of a multicounty 
  2.21  authority.  
  2.22     In the case of a multicounty authority comprising more than 
  2.23  three political subdivisions, the appointing authorities of the 
  2.24  participating political subdivisions may each appoint one up to 
  2.25  two additional commissioner commissioners whose term of office 
  2.26  shall be as provided for a commissioner of a multicounty 
  2.27  authority.  
  2.28     When the area of operation of a multicounty authority is 
  2.29  increased to include an additional political subdivision, the 
  2.30  appointing authority of each additional political subdivision 
  2.31  shall appoint one or, if appropriate, two commissioners of the 
  2.32  multicounty authority.  
  2.33     The appointing authority of each political subdivision 
  2.34  shall appoint the successors of the commissioner appointed by 
  2.35  it.  The commissioners of a multicounty authority shall be 
  2.36  appointed for terms of five years except that all vacancies 
  3.1   shall be filled for the unexpired terms. 
  3.2      Sec. 4.  Minnesota Statutes 1998, section 469.011, 
  3.3   subdivision 4, is amended to read: 
  3.4      Subd. 4.  [EXPENSES; COMPENSATION.] Each commissioner may 
  3.5   receive necessary expenses, including traveling expenses, 
  3.6   incurred in the performance of duties.  Each commissioner may be 
  3.7   paid up to $55 $75 for attending each regular and special 
  3.8   meeting of the authority, except that no more than $55 may be 
  3.9   paid for a meeting of less than four hours duration.  
  3.10  Commissioners who are full-time state employees or full-time 
  3.11  employees of the political subdivisions of the state may not 
  3.12  receive the daily payment, but they may suffer no loss in 
  3.13  compensation or benefits from the state or a political 
  3.14  subdivision as a result of their service on the board. 
  3.15  Commissioners who are elected officials may receive the daily 
  3.16  payment for a particular day only if they do not receive any 
  3.17  other daily payment for public service on that day.  
  3.18  Commissioners who are full-time state employees or full-time 
  3.19  employees of the political subdivisions of the state may receive 
  3.20  the expenses provided for in this subdivision unless the 
  3.21  expenses are reimbursed by another source. 
  3.22     Sec. 5.  [WASHINGTON COUNTY HRA INCREASED TO SEVEN.] 
  3.23     Notwithstanding Minnesota Statutes, section 469.006, 
  3.24  subdivision 1, the Washington county housing and redevelopment 
  3.25  authority has seven members.  The county board must appoint one 
  3.26  member from each county commissioner district after receiving a 
  3.27  recommendation for the position from the district's county 
  3.28  commissioner.  One housing and redevelopment commissioner must 
  3.29  be appointed by the county board to represent the county at 
  3.30  large.  One authority member must be appointed by the county 
  3.31  board from among county residents who are directly assisted by 
  3.32  the public housing agency as defined in Code of Federal 
  3.33  Regulations, title 24, part 964.  The first appointee to an 
  3.34  at-large position serves for two years; thereafter the term is 
  3.35  three years.  The first appointee to the position requiring one 
  3.36  directly assisted by the public housing agency serves for one 
  4.1   year; thereafter the term is three years. 
  4.2      Sec. 6.  [EFFECTIVE DATE; LOCAL APPROVAL.] 
  4.3      Section 5 is effective the day after the governing body of 
  4.4   Washington county and its chief clerical officer timely complete 
  4.5   their compliance with Minnesota Statutes, section 645.021, 
  4.6   subdivisions 2 and 3.
