A bill for an act
relating to transportation; allowing military personnel on active duty outside
Minnesota to retake failed road test before termination of practice period;
amending Minnesota Statutes 2014, section 171.13, by adding a subdivision.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2014, section 171.13, is amended by adding a
subdivision to read:

new text begin (a) A person who fails a skills
or road test may retake the test before the expiration of the applicable practice period if
the person is in active service, as defined under section 190.05, in any branch or unit
of the United States armed forces, including the National Guard of any state and the
United States Coast Guard, and is either: (1) stationed or deployed outside the state of
Minnesota; or (2) has orders to report to duty outside the state of Minnesota before the
termination of the practice period.

new text begin (b) In order to qualify for the military personnel active duty exemption, a person
must present acceptable documentation to the commissioner. Acceptable documentation
consists of: (1) an affidavit in which the person attests to active military status, along with
duty outside the state of Minnesota that is either current or scheduled to begin before the
termination of the practice period; or (2) other documentation deemed acceptable by
the commissioner.
