A bill for an act
relating to health; providing support and counseling for pregnant individuals
experiencing preterm labor and preterm birth; proposing coding for new law in
Minnesota Statutes, chapter 144.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Health care providers must offer to pregnant
individuals experiencing preterm labor, including preterm birth, the following options:

(1) administering tocolytics;
new text end
new text begin
(2) admission to a facility with access to a level III or IV neonatal intensive care unit;
new text end
new text begin
(3) administering magnesium for neurological protection of the baby;
new text end
new text begin
(4) administering corticosteroids for the lung development of the baby; and
new text end
new text begin
(5) providing life-sustaining measures, including full resuscitation measures for any
infant born alive within the pre-viability gestational age.

(a) No disciplinary action shall be taken by a facility or licensing
body against a health care provider who carries out a treatment option pursuant to subdivision
1 when the option was requested by the pregnant individual who is experiencing preterm
labor, including preterm birth.

(b) A health care provider is immune from civil liability for damages, administrative
fines, or penalties for acts authorized under subdivision 1 and carried out under the pregnant
individual's request.
