A bill for an act
relating to environment; requiring definition of off-highway vehicle recreation
area for purposes of environmental review; requiring rulemaking.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1. new text begin OFF-HIGHWAY VEHICLE RECREATION AREA DEFINITION;
RULES.

new text begin (a) The Environmental Quality Board must amend Minnesota Rules, part 4410.0200, to
define "off-highway vehicle recreation area" as provided in paragraph (b).
new text end

new text begin (b) "Off-highway vehicle recreation area" means an area:
new text end

new text begin (1) that is or will be posted or designated to permit the use of off-highway vehicles,
either as the primary use of the area or as one of multiples uses; and
new text end

new text begin (2) where one or more of the following applies:
new text end

new text begin (i) the land has been purchased in whole or in part using money from one or more
dedicated off-highway vehicle accounts, including the off-highway motorcycle account,
off-road vehicle account, and the all-terrain vehicle account;
new text end

new text begin (ii) at least 90 percent of the land is owned by one entity;
new text end

new text begin (iii) there is only one designated parking lot for the project area;
new text end

new text begin (iv) the off-highway vehicle trail density is at least .01 miles per acre over the project
area; or
new text end

new text begin (v) the majority of the project area is on government-owned land.

new text begin (c) The board may use the good cause exemption under Minnesota Statutes, section
14.388, subdivision 1, clause (3), to adopt the rule required under this section, and Minnesota
Statutes, section 14.386, does not apply except as provided under Minnesota Statutes, section
14.388.
