A bill for an act
relating to local government; authorizing the city of Shakopee to abolish the city
public utilities commission or transfer to the city council one or more of the
commission's powers, duties, assets, and liabilities, subject to a reverse referendum.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

new text begin (a) Notwithstanding the procedures required by Minnesota Statutes, section 412.391,
the Shakopee City Council may by resolution abolish the city public utilities commission
and assume control of the city utilities or transfer certain functions of the commission to
the city council.

new text begin (b) Before the adoption of a resolution to abolish or transfer functions of the public
utilities commission, the city must publish the proposed resolution once each week for two
consecutive weeks in the official publication of the city to notify the public of its intent to
consider the issue. Following publication and before adopting the resolution, the city council
must provide an opportunity for public comment on the resolution at a regularly scheduled
meeting of the city council. The city council may adopt the resolution at a separate regularly
scheduled meeting of the city council after the meeting for public comment. The resolution
takes effect 30 days after it is adopted, or at a later date stated in the resolution, unless a
petition is filed as provided in paragraph (c).

new text begin (c) Within 30 days after the city council adopts the resolution, a petition requesting a
referendum may be filed with the city clerk. The petition must be signed by at least ten
percent of the registered voters of the city. The petition must meet the requirements of the
secretary of state, as provided in Minnesota Statutes, section 204B.071, and any rules adopted
to implement that section. If the petition is sufficient, the question of abolishing the
commission or transferring certain functions must be placed on the ballot at a regular or
special election. If a majority of the voters of the city voting on the question vote in favor
of the proposed change, the resolution takes effect 30 days after the election, or at a later
date stated in the resolution.
