A bill for an act
relating to human services; directing the commissioner of human services to conduct
a review of statewide behavioral health treatment capacity and needs; requiring a
report.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1. new text begin DIRECTION TO COMMISSIONER OF HUMAN SERVICES;
BEHAVIORAL HEALTH TREATMENT STATEWIDE REVIEW.

new text begin (a) The commissioner of human services shall conduct a comprehensive review of current
mental health and substance use disorder treatment services and current and anticipated
mental health and substance use disorder treatment needs for adults and children throughout
the state. The review shall consist of the following:

new text begin (1) a comprehensive list of available behavioral health treatment services, including the
level of treatment intensity, whether the service is provided in a community-based or
residential setting, age groups served, and any additional client eligibility requirements;

new text begin (2) an evaluation of the accessibility and geographical distribution of each behavioral
health treatment service available statewide;
new text end

new text begin (3) an evaluation of community-based services and residential treatment facility capacity
and census data; and
new text end

new text begin (4) identification of behavioral health treatment services or groups of eligible individuals
with the most unmet need for services.

new text begin (b) The commissioner must also work with the commissioner of health to conduct a
review, using the five factors listed in Minnesota Statutes, section 144.552, paragraph (c),
to reach a finding on whether increasing the number of residential behavioral health treatment
beds would be in the public interest.

new text begin (c) No later than January 31, 2023, the commissioner of human services shall provide
a report on the behavioral health treatment statewide review to the legislative committees
and divisions with jurisdiction over human services policy and finance and behavioral health
and include any proposed legislation to improve behavioral health treatment capacity,
accessibility, and effectiveness.
