A bill for an act
relating to higher education; establishing a cause of action for damages incurred
from mandatory immunization; proposing coding for new law in Minnesota
Statutes, chapter 137.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

(a) A student or employee may bring a civil action at any time in district court for
damages against the Board of Regents if the Board of Regents required the student or
employee to receive an immunization and the student or employee experienced serious
illness or injury as a result of the immunization. The court shall award actual damages and
reasonable attorney fees and costs to a prevailing plaintiff.

(b) For the purposes of this section, "employee" has the meaning given in section 181.950,
subdivision 6, and includes an unpaid intern or volunteer treated as an employee for purposes
of a vaccination mandate.

This section is effective the day following final enactment and
applies retroactively to causes of actions arising on or after January 1, 2021.
