A bill for an act
relating to higher education; requiring the Board of Trustees of the Minnesota
State Colleges and Universities to submit a plan to transfer technical colleges.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1. new text begin TRANSFER OF TECHNICAL COLLEGES.

new text begin (a) By January 1, 2019, the Board of Trustees of the Minnesota State Colleges and
Universities shall submit a plan to transfer the technical colleges from the Minnesota State
Colleges and Universities to entities in the kindergarten through grade 12 system. The plan
must be submitted to the chairs and ranking minority members of the legislative committees
with jurisdiction over higher education and kindergarten through grade 12 education policy
and finance. The plan must:

new text begin (1) if executed, transfer all technical colleges from the Minnesota State Colleges and
Universities system by the beginning of the 2021-2022 school year;

new text begin (2) identify each technical college that has received state bonding money for which
transfer of the facility may require facilitation in a bonding bill; and

new text begin (3) propose updates to the system's credit transfer policies to continue to recognize credits
earned at the transferred institutions.

new text begin (b) In establishing the plan, the board of trustees shall consult the Department of
Education, school districts within a .... mile radius of each technical college, and other
stakeholders, as necessary, to identify changes in the education code necessary to facilitate
the transfer, including:

new text begin (1) proposed changes to the funding formulas in Minnesota Statutes, chapter 126C;
new text end

new text begin (2) facilitation of financial aid processing;
new text end

new text begin (3) establishing authority to grant associate degrees; and
new text end

new text begin (4) facilitation of tuition collection.
