A bill for an act
relating to retirement; providing coverage in the public employees police and fire
plan for fire inspectors; amending Minnesota Statutes 2006, section 353.64, by
adding a subdivision.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2006, section 353.64, is amended by adding a
subdivision to read:

new text begin Pension coverage for fire inspectors. new text end

new text begin (a) A person is a member of the
public employees police and fire plan if the person:

new text begin (1) is employed by a fire department of a governmental subdivision full time as a
fire inspector or full time in a position that combines the duties of a fire inspector and a
firefighter; and

new text begin (2) is not eligible for coverage by the federal Old Age, Survivors, and Disability
Insurance Act under the agreement signed between the state and the secretary of the
United States Department of Health and Human Services because the person's position is
excluded from coverage under section 355.07 and United States Code, title 42, sections
418(d)(5)(A) and 418(d)(8)(D).

new text begin (b) The employer of a person covered by this subdivision must deduct the employee
contribution from the salary of each covered person as required by section 353.65,
subdivision 2, make the employer contribution as required by section 353.65, subdivision
3, and meet the employer recording and reporting requirements in section 353.65,
subdivision 4.

new text begin This section is effective for employment on and after the first
day of the first full payroll period after the executive director of the Public Employees
Retirement Association receives a written determination from the secretary of the United
States Department of Health and Human Services that employees specified in this section
are ineligible for coverage under the federal Old Age, Survivors, and Disability Insurance
Act.
