  1.1                          A bill for an act 
  1.2             relating to game and fish; prohibiting fishing in 
  1.3             designated swimming areas; amending Minnesota Statutes 
  1.4             1998, section 97C.025. 
  1.5   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.6      Section 1.  Minnesota Statutes 1998, section 97C.025, is 
  1.7   amended to read: 
  1.8      97C.025 [FISHING AND MOTORBOATS PROHIBITED IN CERTAIN 
  1.9   AREAS.] 
  1.10     Subdivision 1.  [DISCRETIONARY PROHIBITION.] (a) The 
  1.11  commissioner may prohibit fishing or the operation of motorboats 
  1.12  by posting waters that: 
  1.13     (1) are designated as spawning beds or fish preserves; or 
  1.14     (2) are being used by the commissioner for fisheries 
  1.15  research or management activities.  
  1.16  An area may be posted under this paragraph if necessary to 
  1.17  prevent excessive depletion of fish or interference with 
  1.18  fisheries research or management activities. 
  1.19     (b) Except as provided in paragraph (c), a person may not 
  1.20  take fish or operate a motorboat if prohibited by posting under 
  1.21  paragraph (a). 
  1.22     (c) An owner of riparian land adjacent to an area posted 
  1.23  under paragraph (a) may operate a motorboat through the area by 
  1.24  the shortest direct route at a speed of not more than five miles 
  1.25  per hour. 
  2.1      Subd. 2.  [PROHIBITION.] A person may not take fish within 
  2.2   a water area that is designated as a swimming or bathing area 
  2.3   according to rules adopted under section 86B.211 when there are 
  2.4   swimmers or bathers present in the water area.
