  1.1                          A bill for an act 
  1.2             relating to commerce; regulating certain motor vehicle 
  1.3             sales; amending Minnesota Statutes 1998, section 
  1.4             168.275. 
  1.5   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.6      Section 1.  Minnesota Statutes 1998, section 168.275, is 
  1.7   amended to read: 
  1.8      168.275 [SALE OF MOTOR VEHICLE ON SUNDAY FORBIDDEN.] 
  1.9      Any person who shall carry on or engage in the business of 
  1.10  buying, selling, exchanging, dealing in or trading in new or 
  1.11  used motor vehicles; or who shall open any place of business or 
  1.12  lot wherein the person attempts to or does engage in the 
  1.13  business of buying, selling, exchanging, dealing or trading in 
  1.14  new or used motor vehicles; or who does buy, sell, exchange, 
  1.15  deal or trade in new or used motor vehicles as a business on the 
  1.16  first day of the week, commonly known and designated as Sunday, 
  1.17  is guilty of a misdemeanor for the first offense, and a gross 
  1.18  misdemeanor for each succeeding offense.  Such a person upon 
  1.19  conviction for the first offense shall pay a fine not to exceed 
  1.20  $700 or be imprisoned for a period of not more than ten days; 
  1.21  and for the second offense shall pay a fine not to exceed $3,000 
  1.22  or be imprisoned for a period of not more than 30 days or both; 
  1.23  and for the third or each subsequent offense shall pay a fine of 
  1.24  not more than $3,000 or be imprisoned for a period of not more 
  1.25  than six months or both.  This section does not apply to the 
  2.1   sale of (1) trailers designed and used primarily to transport 
  2.2   watercraft, as defined in section 86B.005, subdivision 18, (2) 
  2.3   trailers designed and used primarily to transport all-terrain 
  2.4   vehicles, as defined in section 84.92, subdivision 8, (3) 
  2.5   trailers designed and used primarily to transport snowmobiles as 
  2.6   defined in section 84.81, subdivision 3, or (4) utility trailers 
  2.7   as defined in section 168.27, subdivision 20. 
  2.8      It is not a violation of this section for a person 
  2.9   otherwise subject to this section to receive, accept, 
  2.10  acknowledge, or otherwise process a motor vehicle order via the 
  2.11  Internet. 
  2.12     Sec. 2.  [EFFECTIVE DATE.] 
  2.13     Section 1 is effective the day following final enactment.
