  1.1                          A bill for an act 
  1.2             relating to liquor; authorizing exclusive liquor 
  1.3             stores to conduct wine tastings under certain 
  1.4             restrictions; proposing coding for new law in 
  1.5             Minnesota Statutes, chapter 340A. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  [340A.419] [WINE TASTINGS AT EXCLUSIVE LIQUOR 
  1.8   STORES.] 
  1.9      Subdivision 1.  [DEFINITION.] For purposes of this section, 
  1.10  a "wine tasting" is an event of not more than four hours' 
  1.11  duration at which persons pay a fee to participate, and are 
  1.12  allowed to consume wine by the glass without paying a separate 
  1.13  charge for each glass. 
  1.14     Subd. 2.  [TASTINGS.] (a) Notwithstanding any other law, an 
  1.15  exclusive liquor store may conduct a wine tasting on the 
  1.16  premises of a holder of an on-sale intoxicating liquor license 
  1.17  that is not a temporary license, if the exclusive liquor store 
  1.18  complies with this section. 
  1.19     (b) No wine at a wine tasting under this section may be 
  1.20  sold for off-premises consumption.  A participant in the tasting 
  1.21  may fill out a form indicating preferences for wine.  The form 
  1.22  may be held on the premises of the exclusive liquor store to 
  1.23  assist the participant in making an off-sale purchase at a later 
  1.24  date. 
  1.25     (c) Notwithstanding any other law, an exclusive liquor 
  2.1   store may purchase or otherwise obtain wine for a wine tasting 
  2.2   conducted under this section from a wholesaler licensed to sell 
  2.3   wine.  The wholesaler may sell or give wine to an exclusive 
  2.4   liquor store for a wine tasting conducted under this section and 
  2.5   may provide personnel to assist in the wine tasting. 
  2.6      (d) An exclusive liquor store that conducts a wine tasting 
  2.7   under this section must use any fees collected from participants 
  2.8   in the tasting only to defray the cost of conducting the tasting.
