A bill for an act
relating to workers' compensation; providing for disability payments to an
employee of a bomb squad.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1. new text begin PERMANENT TOTAL DISABILITY BENEFITS FOR BOMB
SQUAD EMPLOYEES.

new text begin Notwithstanding any law to the contrary, the employer or former employer of a
public employee who was injured in February 2005 while working on a bomb squad
must pay the person permanent total disability benefits under Minnesota Statutes, chapter
176, equal to the difference between: (1) the salary the person received from the public
employer at the time of the injury; and (2) the disability benefit the person receives from
the Public Employees Retirement Association. The salary used as the basis for calculating
the payment under this section must be deemed to increase by the same percentage as the
annual increase in Social Security benefits. The weekly payments required under this
section must continue until the employee who was injured attains age 67.
