A bill for an act
relating to liquor; creating an additional production license for microdistilleries;
amending Minnesota Statutes 2014, section 340A.101, subdivision 17a;
Minnesota Statutes 2015 Supplement, section 340A.22, by adding a subdivision.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2014, section 340A.101, subdivision 17a, is amended to
read:


Subd. 17a.

Microdistillery.

"Microdistillery" is a distillery operated within the state
producing premium, distilled spirits in total quantity not to exceed 40,000 proof gallons in
a calendar yearnew text begin , for a standard license, and not more than 50,000 gallons per year, with an
extended production license under section 340A.22, subdivision 5

Sec. 2.

Minnesota Statutes 2015 Supplement, section 340A.22, is amended by adding a
subdivision to read:

new text begin A microdistillery may purchase an
additional production license, for a fee not to exceed $50, which shall allow production
in excess of 40,000 proof gallons, but not more than 50,000 proof gallons in a calendar
year, provided that these additional production amounts must not be sold during the year
of production.

new text begin This section is effective the day following final enactment,
and additional production limits allowed under this section shall be allowed retroactively
with the purchase of an additional production license for each of those prior years.
