  1.1                          A bill for an act 
  1.2             relating to state government; authorizing 
  1.3             health-related boards to carry forward balances; 
  1.4             amending Minnesota Statutes 1998, section 16A.28, by 
  1.5             adding a subdivision; proposing coding for new law in 
  1.6             Minnesota Statutes, chapter 214. 
  1.7   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.8      Section 1.  Minnesota Statutes 1998, section 16A.28, is 
  1.9   amended by adding a subdivision to read: 
  1.10     Subd. 9.  [HEALTH-RELATED BOARDS.] A health-related 
  1.11  licensing board may carry forward balances from one biennium to 
  1.12  future bienniums as authorized by section 214.085. 
  1.13     Sec. 2.  [214.085] [CARRYFORWARD AUTHORITY.] 
  1.14     Notwithstanding sections 16A.1285, subdivision 2, and 
  1.15  214.06, subdivision 1, upon approval of a request from a 
  1.16  health-related licensing board, the commissioner of finance may 
  1.17  create a special account allowing the board to carry forward up 
  1.18  to $100,000 of an unexpended and unencumbered appropriation from 
  1.19  the end of one biennium into future bienniums.  The cumulative 
  1.20  balance of this account shall not exceed $100,000.  A balance 
  1.21  carried forward may be used only for unanticipated expenses, 
  1.22  fees, or costs that are directly related to investigation of a 
  1.23  complaint or conduct of a contested case hearing.  Expenditures 
  1.24  from the account may be made only for the following purposes:  
  1.25     (1) office of administrative hearings costs; 
  1.26     (2) attorney general expenses; 
  2.1      (3) consultant and witness fees; and 
  2.2      (4) communications and related costs.
