A bill for an act
relating to local government; authorizing a turn lane fee to be imposed by certain
towns in Scott County under certain circumstances.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1. new text begin SCOTT COUNTY, TOWN TURN LANE FEE AUTHORIZED.

new text begin The board of supervisors of a town with territory within the Scott County Rural
Residential Service Area Detailed Area Plan, adopted in 2009, and as may be amended from
time to time, may charge the developer of a proposed residential subdivision a fee for each
lot developed, or lot equivalent, at the time the proposed residential subdivision plat is
approved. The fee is to pay part or all of the costs of new turn lanes and bypass lanes within
or adjacent to the proposed residential subdivision. The fee must be based on an engineering
study of the area that determines the probable number and aggregate cost of all turn lanes
and bypass lanes that will be required at full build-out of the subdivision. The estimated
aggregate costs must be divided by the engineer's written determination of the number of
lots that will exist when the subdivision is fully developed, based on zoning as of the time
of subdivision application. The town board must keep the fees collected in a separate account
that is used only for the construction of turn lanes and bypass lanes in the area, and any
related costs. A town collecting the fee must construct turn lanes and bypass lanes as they
are needed, based on the county and town adopted plans and policies.
