  1.1                          A bill for an act 
  1.2             relating to transportation; prohibiting expenditures 
  1.3             of trunk highway funds for certain purposes relating 
  1.4             to light rail transit; amending Minnesota Statutes 
  1.5             1998, section 174.35. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  Minnesota Statutes 1998, section 174.35, is 
  1.8   amended to read: 
  1.9      174.35 [LIGHT RAIL TRANSIT.] 
  1.10     Subdivision 1.  [AUTHORIZATION.] The commissioner of 
  1.11  transportation may exercise the powers granted in this chapter 
  1.12  and chapter 473, as necessary, to plan, design, acquire, 
  1.13  construct, and equip light rail transit facilities in the 
  1.14  metropolitan area as defined in section 473.121, subdivision 2. 
  1.15     Subd. 2.  [PROHIBITION.] The commissioner shall not spend 
  1.16  any money appropriated from the trunk highway fund for (1) any 
  1.17  of the activities described in subdivision 1, (2) the 
  1.18  acquisition of real property to the extent that the real 
  1.19  property will be used exclusively or primarily for light rail 
  1.20  transit, or (3) the rerouting of any highway, or the 
  1.21  construction or reconstruction of highway overpasses, to the 
  1.22  extent that the rerouting, construction, or reconstruction is 
  1.23  necessitated exclusively or primarily by the construction of 
  1.24  light rail transit. 
  1.25     Sec. 2.  [EFFECTIVE DATE.] 
  2.1      Section 1 is effective February 1, 2000.
