A bill for an act
relating to insurance; requiring compliance with federal law regarding health
insurance coverage of clinical trials; providing an earlier effective date than
federal law; proposing coding for new law in Minnesota Statutes, chapter 62Q.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

ROUTINE PATIENT COSTS.

new text begin (a) A health plan issued or renewed by a health plan company to cover a resident of
this state must comply with the provisions relating to coverage of routine patient costs
incurred in connection with clinical trials contained in section 2709 of the federal Public
Health Service Act, as added by Title X, Subtitle A, section 10103, paragraph (c), of the
federal Patient Protection and Affordable Care Act, Public Law 111-148.

new text begin (b) Compliance with paragraph (a) is required under this section effective on or after
August 1, 2011, for health plans offered, sold, issued, renewed, or continued as defined in
section 60A.02, subdivision 2a.

new text begin (c) This section applies to health plans and health plan companies to the full extent
not preempted by federal law. It does not apply to self-insured group health plans
sponsored by private sector employers or by multiple employer unions or to the Federal
Employee Health Benefits Plan.
