  1.1                          A bill for an act 
  1.2             relating to education; establishing criteria for 
  1.3             district and school contracts for electronic products 
  1.4             or services that require advertising to be 
  1.5             disseminated to students; proposing coding for new law 
  1.6             in Minnesota Statutes, chapter 123B. 
  1.7   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.8      Section 1.  [123B.055] [CONTRACTS FOR ELECTRONIC PRODUCTS 
  1.9   OR SERVICES.] 
  1.10     The school board of a school district may not enter into a 
  1.11  contract or permit a school within the district to enter into a 
  1.12  contract for an electronic product or service that requires 
  1.13  advertising to be disseminated to students unless the school 
  1.14  board: 
  1.15     (1) enters into the contract at a public hearing of the 
  1.16  school board; 
  1.17     (2) makes a finding that the offered electronic product or 
  1.18  service is an integral component of students' education; 
  1.19     (3) makes a finding that the school district cannot afford 
  1.20  to provide the electronic product or service unless it contracts 
  1.21  to permit advertising to be disseminated to students; 
  1.22     (4) provides written notice to students' parents that 
  1.23  advertising will be used in the classroom, media center, 
  1.24  computer lab, or other areas of learning; 
  1.25     (5) as part of normal, ongoing district communications with 
  1.26  parents, allows parents to request in writing that (i) their 
  2.1   student not be exposed to the program that contains the 
  2.2   advertising for the current school year, or that (ii) any or all 
  2.3   directory information relating to the student that is collected 
  2.4   as a result of this contract is not disclosed; and 
  2.5      (6) honors parents' request, under clause (5), that their 
  2.6   student not be exposed to the advertising program or that 
  2.7   directory information relating to the student is not disclosed 
  2.8   and allows parents to withdraw their request at any time. 
  2.9      Sec. 2.  [EFFECTIVE DATE.] 
  2.10     Section 1 is effective the day following final enactment.
