  1.1                          A bill for an act 
  1.2             relating to education funding; providing for 
  1.3             calculation of pupil units for interactive Web-based 
  1.4             programs; providing for availability of appropriation 
  1.5             for Web-based study reimbursements; amending Minnesota 
  1.6             Statutes 2000, section 126C.05, by adding a 
  1.7             subdivision; Laws 2001, First Special Session chapter 
  1.8             6, article 4, section 27, subdivision 9. 
  1.9   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.10     Section 1.  Minnesota Statutes 2000, section 126C.05, is 
  1.11  amended by adding a subdivision to read: 
  1.12     Subd. 19.  [INTERACTIVE WEB-BASED PROGRAMS.] (a) Average 
  1.13  daily membership for an eligible pupil in an approved 
  1.14  interactive Web-based, course-equivalent program offered by a 
  1.15  school district or a charter school, and accessed by pupils 
  1.16  outside of the regular school day or from a location other than 
  1.17  a public school building, under the direction of a teacher with 
  1.18  a Minnesota license, must be calculated according to this 
  1.19  subdivision.  For purposes of this subdivision, an eligible 
  1.20  pupil is a public school pupil concurrently enrolled for a 
  1.21  minimum of five hours per week in an instructional program at a 
  1.22  public school building in the district or charter school or a 
  1.23  public school building in another district or charter school and 
  1.24  participating in the program by agreement with the district or 
  1.25  charter school of enrollment.  Average daily membership for a 
  1.26  pupil shall equal the number of hours of completed coursework 
  1.27  needed for grade progression, credit, or alignment with state 
  2.1   graduation standards divided by the number of hours required for 
  2.2   a full-time student in the district or charter school.  The 
  2.3   course of study must be approved by the commissioner of 
  2.4   children, families, and learning for: 
  2.5      (1) grade progression, credit, or alignment with the state 
  2.6   graduation standards; 
  2.7      (2) teacher licensure; and 
  2.8      (3) compliance with chapter 125A. 
  2.9   Pupils enrolled in the program must not be counted as more than 
  2.10  1.0 pupil in average daily membership.  A school district or 
  2.11  charter school is not required to provide a pupil enrolled in 
  2.12  the program with access to a computer or to the Internet. 
  2.13     (b) Notwithstanding paragraph (a), pupils enrolled in a 
  2.14  Web-based public alternative program approved by the 
  2.15  commissioner before June 1, 2001, are not required to be 
  2.16  concurrently enrolled in the district. 
  2.17     Sec. 2.  Laws 2001, First Special Session chapter 6, 
  2.18  article 4, section 27, subdivision 9, is amended to read: 
  2.19     Subd. 9.  [REIMBURSEMENT FOR WEB-BASED AND INDEPENDENT 
  2.20  STUDY COURSES.] For grants to school districts and charter 
  2.21  schools for additional pupils taking on-line courses according 
  2.22  to section 25: 
  2.23       $100,000     .....     2002 
  2.24     This appropriation is available until June 30, 2003.
