  1.1                          A bill for an act 
  1.2             relating to airports; requiring items confiscated at 
  1.3             airports to be mailed on behalf of the owner; 
  1.4             proposing coding for new law in Minnesota Statutes, 
  1.5             chapter 360. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  [360.94] [RETURNING ITEM CONFISCATED FROM 
  1.8   AIRLINE TRAVELER.] 
  1.9      (a) An item must be allowed to be mailed to its owner if 
  1.10  the item was confiscated from an airline traveler because it was 
  1.11  not allowed to be transported in the passenger compartment but, 
  1.12  if the item had been properly packed, would have been allowed to 
  1.13  be stowed and transported in the luggage compartment away from 
  1.14  the passengers and where it would be incapable of being 
  1.15  retrieved by a passenger while on the airplane. 
  1.16     (b) The company in charge of airport security shall allow 
  1.17  the owner of a confiscated item described in paragraph (a) to 
  1.18  elect to mail the item to the owner's residence upon payment by 
  1.19  the owner of mailing or shipping costs. 
  1.20     (c) The item may be destroyed only if the owner of a 
  1.21  confiscated item (1) does not make the election under paragraph 
  1.22  (b), or (2) elects to have the item mailed to the owner's 
  1.23  residence but fails to pay the mailing or shipping costs. 
  1.24     (d) This section applies to every public and private 
  1.25  airport located in Minnesota.
