A bill for an act
relating to health; prohibiting the substitution of a prescription for an
immunosuppressant drug; amending Minnesota Statutes 2006, section 151.21, by
adding a subdivision.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:
Minnesota Statutes 2006, section 151.21, is amended by adding a
subdivision to read:

Notwithstanding subdivision
3, a pharmacist shall not interchange a prescription for an immunosuppressant drug for
the treatment of transplantation with any other drug without the prior notification and
approval of the prescriber. For the purpose of this subdivision:

(1) an "immunosuppressant drug" means any drug used to prevent organ rejection in
individuals who have had an organ transplantation; and

(2) "interchange" means the substitution of another version of the same
immunosuppressant drug, including a generic version for the prescribed brand, a brand
version for the prescribed generic version, a generic version by one manufacturer
for a generic version by a different manufacturer, a different formulation for the
prescribed immunosuppressant, or a different immunosuppressant drug product from the
immunosuppressant drug originally prescribed.
