1.1A resolution
1.2urging Congress to adopt legislation delaying certain regulation of greenhouse gas
1.3emissions.
1.4WHEREAS, the Minnesota Legislature wishes to express the need for the United States
1.5Congress to help provide a fair and effective approach for climate and energy supply issues that
1.6safeguards American jobs, ensures affordable energy for America, and maintains America's
1.7global competitiveness; and
1.8WHEREAS, the U.S. Environmental Protection Agency's plan to regulate greenhouse
1.9gas (GHG) emissions from new cars and light trucks will trigger the same regulation of GHG
1.10emissions from stationary sources like manufacturing facilities, power plants, hospitals, and
1.11commercial establishments; and
1.12WHEREAS, regulating greenhouse gas emissions from "stationary sources" under the
1.13Clean Air Act would be a great burden on manufacturing and the economy in general; and
1.14WHEREAS, the pending EPA effort would burden progress on two of the nation's top
1.15priorities, environmental improvement and economic recovery, by imposing onerous permitting
1.16requirements that will significantly delay or even eliminate investments in new energy efficient
1.17technologies; and
1.18WHEREAS, over four million jobs were lost in 2009 and these proposed regulations have
1.19the potential to cause even more job losses; and
1.20WHEREAS, the regulatory requirements of the Clean Air Act will overwhelm state agencies
1.21which are not equipped to handle the estimated six million permitting requests anticipated; and
2.1WHEREAS, only Congress can act to avoid the significant costs and burdens imposed by
2.2the regulations on stationary sources, which even the EPA admits will lead to "absurd results";
2.3NOW, THEREFORE,
2.4BE IT RESOLVED by the Legislature of the State of Minnesota that it encourages the
2.5Congress of the United States to adopt legislation that would postpone the EPA's effort to regulate
2.6greenhouse gas emissions from stationary sources using existing Clean Air Act authority until
2.7Congress adopts a balanced approach to address climate and energy supply issues without
2.8crippling the economy.
2.9BE IT FURTHER RESOLVED that the Secretary of State of the State of Minnesota is
2.10directed to prepare copies of this memorial and transmit them to the President of the United
2.11States, the President and the Secretary of the United States Senate, the Speaker and the Clerk of
2.12the United States House of Representatives, the chair of the Senate Committee on Environment
2.13and Public Works, the chair of the House Committee on Energy and Commerce, and Minnesota's
2.14Senators and Representatives in Congress.
