1.1 A bill for an act 1.2 relating to governmental operations; requiring 1.3 legislative approval of certain contracts between an 1.4 executive branch agency and an agency of the federal 1.5 government or a nongovernmental organization; 1.6 proposing coding for new law in Minnesota Statutes, 1.7 chapter 15. 1.8 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 1.9 Section 1. [15.0545] [LEGISLATIVE APPROVAL OF FEDERAL 1.10 AGREEMENTS.] 1.11 Notwithstanding sections 3.3005 and 4.07, or other law to 1.12 the contrary, an executive branch state agency or an elected or 1.13 appointed executive branch officer may not enter into a contract 1.14 or other agreement with an agency of the federal government, 1.15 including the department of education, or with a nongovernmental 1.16 organization until the contract or other agreement is approved 1.17 by the legislature. This section does not apply to: 1.18 (1) a contract or agreement that does not affect public 1.19 policy; 1.20 (2) a contract or agreement under which the state agency 1.21 receives money from the federal government, if the contract or 1.22 agreement: (i) does not require any matching state money; and 1.23 (ii) does not impose any present or future conditions or 1.24 obligations on the state or a local unit of government. 1.25 Sec. 2. [EFFECTIVE DATE.] 1.26 Section 1 is effective the day following final enactment.
