  1.1                          A bill for an act 
  1.2             relating to drivers' licenses; authorizing nicknames 
  1.3             on drivers' licenses; amending Minnesota Statutes 
  1.4             2000, section 171.06, subdivision 3; Minnesota 
  1.5             Statutes 2001 Supplement, section 171.07, subdivision 
  1.6             1. 
  1.7   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.8      Section 1.  Minnesota Statutes 2000, section 171.06, 
  1.9   subdivision 3, is amended to read: 
  1.10     Subd. 3.  [CONTENTS OF APPLICATION; OTHER INFORMATION.] (a) 
  1.11  An application must state the full name, nickname if the 
  1.12  applicant desires to have it included on the license, date of 
  1.13  birth, sex and residence address of the applicant, a description 
  1.14  of the applicant in such manner as the commissioner may require, 
  1.15  and must state whether or not the applicant has theretofore been 
  1.16  licensed as a driver; and, if so, when and by what state or 
  1.17  country and whether any such license has ever been suspended or 
  1.18  revoked, or whether an application has ever been refused; and, 
  1.19  if so, the date of and reason for such suspension, revocation, 
  1.20  or refusal, together with such facts pertaining to the applicant 
  1.21  and the applicant's ability to operate a motor vehicle with 
  1.22  safety as may be required by the commissioner.  An application 
  1.23  for a class C, class B, or class A driver's license also must 
  1.24  state the applicant's social security number.  An application 
  1.25  for a class D driver's license must have a space for the 
  1.26  applicant's social security number and state that providing the 
  2.1   number is optional, or otherwise convey that the applicant is 
  2.2   not required to enter the social security number.  The 
  2.3   application form must contain a space where the applicant may 
  2.4   indicate a desire to make an anatomical gift.  If the applicant 
  2.5   does not indicate a desire to make an anatomical gift when the 
  2.6   application is made, the applicant must be offered a donor 
  2.7   document in accordance with section 171.07, subdivision 5.  The 
  2.8   application form must contain statements sufficient to comply 
  2.9   with the requirements of the Uniform Anatomical Gift Act (1987), 
  2.10  sections 525.921 to 525.9224, so that execution of the 
  2.11  application or donor document will make the anatomical gift as 
  2.12  provided in section 171.07, subdivision 5, for those indicating 
  2.13  a desire to make an anatomical gift.  The application form must 
  2.14  contain a notification to the applicant of the availability of a 
  2.15  living will/health care directive designation on the license 
  2.16  under section 171.07, subdivision 7.  The application must be in 
  2.17  the form prepared by the commissioner.  
  2.18     (b) The application form must be accompanied by a pamphlet 
  2.19  containing relevant facts relating to:  
  2.20     (1) the effect of alcohol on driving ability; 
  2.21     (2) the effect of mixing alcohol with drugs; 
  2.22     (3) the laws of Minnesota relating to operation of a motor 
  2.23  vehicle while under the influence of alcohol or a controlled 
  2.24  substance; and 
  2.25     (4) the levels of alcohol-related fatalities and accidents 
  2.26  in Minnesota and of arrests for alcohol-related violations. 
  2.27     (c) The application form must also be accompanied by a 
  2.28  pamphlet describing Minnesota laws regarding anatomical gifts 
  2.29  and the need for and benefits of anatomical gifts. 
  2.30     Sec. 2.  Minnesota Statutes 2001 Supplement, section 
  2.31  171.07, subdivision 1, is amended to read: 
  2.32     Subdivision 1.  [LICENSE; CONTENTS.] Upon the payment of 
  2.33  the required fee, the department shall issue to every qualifying 
  2.34  applicant a license designating the type or class of vehicles 
  2.35  the applicant is authorized to drive as applied for.  This 
  2.36  license must bear a distinguishing number assigned to the 
  3.1   licensee, the full name, nickname as shown on the application if 
  3.2   the applicant desires to have the nickname included, date of 
  3.3   birth, residence address and permanent mailing address if 
  3.4   different, a description of the licensee in such manner as the 
  3.5   commissioner deems necessary, and a space upon which the 
  3.6   licensee shall write the usual signature and the date of birth 
  3.7   of the licensee.  No license is valid until it has been signed 
  3.8   by the licensee.  Except in the case of an instruction permit, 
  3.9   every license must bear a colored photograph or an 
  3.10  electronically produced image of the licensee.  Every license 
  3.11  issued to an applicant under the age of 21 must be of a 
  3.12  distinguishing color and plainly marked "Under-21."  The 
  3.13  department shall use such process or processes in the issuance 
  3.14  of licenses that prohibits, as near as possible, the ability to 
  3.15  alter or reproduce the licenses, or prohibit the ability to 
  3.16  superimpose a photograph or electronically produced image on the 
  3.17  licenses, without ready detection.  A license issued to an 
  3.18  applicant age 65 or over must be plainly marked "senior" if 
  3.19  requested by the applicant.
