  1.1                          A bill for an act 
  1.2             relating to drivers' licenses; authorizing seizure of 
  1.3             driver's license and Minnesota identification card of 
  1.4             person removed from the United States; providing for 
  1.5             cancellation of driver's license and Minnesota 
  1.6             identification card; amending Minnesota Statutes 1998, 
  1.7             section 171.14; proposing coding for new law in 
  1.8             Minnesota Statutes, chapter 171. 
  1.9   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.10     Section 1.  [171.132] [SEIZURE OF LICENSES.] 
  1.11     An agent of the United States immigration and 
  1.12  naturalization service may seize and return to the commissioner 
  1.13  a driver's license or Minnesota identification card held by a 
  1.14  person who has been removed from the United States by reason of 
  1.15  having entered the United States in violation of law. 
  1.16     Sec. 2.  Minnesota Statutes 1998, section 171.14, is 
  1.17  amended to read: 
  1.18     171.14 [CANCELLATION.] 
  1.19     (a) The commissioner shall have authority to may cancel any 
  1.20  driver's license upon determination that the licensee was not 
  1.21  entitled to the issuance thereof hereunder, or that the licensee 
  1.22  failed to give the required or correct information in the 
  1.23  application, or committed any fraud or deceit in making such 
  1.24  application. 
  1.25     (b) The commissioner may also cancel the driver's license 
  1.26  of any person who, at the time of the cancellation, would not 
  1.27  have been entitled to receive a license under the provisions of 
  2.1   section 171.04.  
  2.2      (c) The commissioner shall cancel a driver's license or 
  2.3   Minnesota identification card that has been returned to the 
  2.4   commissioner by the United States immigration and naturalization 
  2.5   service under section 171.132.
