A bill for an act
relating to the State Building Code; establishing standards for installation of
flashing in certain new construction and remodeling; requiring the commissioner
of labor and industry to adopt rules modifying the State Building Code; proposing
coding for new law in Minnesota Statutes, chapter 16B.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

In construction subject to the State Building Code, flashing
shall be installed shingle fashion integral with the water-resistant barrier with minimum
overlaps of two inches on all joints and seams. The water-resistant barrier overlap to the
outside of the approved corrosion resistant flashing above the fenestration must be a
minimum of two inches. Taping the water-resistant barrier to the flashing as long as the
water-resistant barrier overlaps at least two inches to the outside of the top of the flashing
above the fenestration is permitted. Caulking a flashing above a window head flashing
and below a trim board in a manner that prevents free drainage or creates a dam that
prevents free drainage is prohibited. Flashing that extends to either the surface of the
exterior wall finish or the exterior of the water-resistant barrier is permitted. Approved
corrosion-resistant flashing must be installed at exterior windows, door openings, light
fixtures, plumbing lines, trim boards, and all other wall fenestrations and penetrations,
and flashings at all wall fenestrations and penetrations must extend to the surface
of the exterior wall finish or to the exterior of the water-resistant barrier. Approved
corrosion-resistant flashing must be installed continuously above all projecting trim and
where exterior porches, decks, or stairs attach to a wall or floor assembly. Kick out
flashings must extend a minimum of five inches out from vertical walls. Pan flashings
must extend to the exterior surface of the cladding, or overlap to the outside of the
weather-resistant barrier by a minimum of two inches. A flat pan flashing must be sealed
with a back dam at least one-quarter inch in height and side dams at least two inches in
height. Repairs or replacements of existing windows must be flashed either in accordance
with the manufacturer's installation instructions, using a method approved by a registered
design professional, or using a method published on the State Building Code Web site.

The commissioner of labor and industry shall adopt rules to
implement this section.

Section 1 is effective for new construction, or alterations exceeding 50 percent of the
estimated replacement value of an existing building, which begins after July 1, 2009.
