  1.1                          A bill for an act 
  1.2             relating to consumer protection; regulating motor 
  1.3             vehicle recall repairs; requiring dealers to notify 
  1.4             consumers under certain conditions; proposing coding 
  1.5             for new law in Minnesota Statutes, chapter 325F. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  [325F.661] [MOTOR VEHICLE RECALLS; 
  1.8   NOTIFICATIONS TO CONSUMERS.] 
  1.9      Subdivision 1.  [DEFINITIONS.] For the purposes of this 
  1.10  section, the following terms have the meanings given them: 
  1.11     (1) "consumer" means the purchaser, lessee, or owner of a 
  1.12  motor vehicle; 
  1.13     (2) "manufacturer" means a person engaged in the business 
  1.14  of manufacturing, assembling, or distributing motor vehicles, 
  1.15  who will, under normal business conditions during the year, 
  1.16  manufacture, assemble, or distribute to dealers at least ten new 
  1.17  motor vehicles; 
  1.18     (3) "motor vehicle" means (i) a passenger automobile as 
  1.19  defined in section 168.011, subdivision 7, including pickup 
  1.20  trucks and vans, and (ii) the self-propelled motor vehicle 
  1.21  chassis or van portion of recreational equipment as defined in 
  1.22  section 168.011, subdivision 25, which is sold or leased to a 
  1.23  consumer in this state; 
  1.24     (4) "dealer" means a licensed new motor vehicle dealer 
  1.25  franchised to sell the motor vehicle; and 
  2.1      (5) "recall" means a manufacturer initiated and announced 
  2.2   request or offer to repair or replace defective motor vehicle 
  2.3   products or parts. 
  2.4      Subd. 2.  [NOTICE OF RECALL AND DUTY TO INFORM 
  2.5   CONSUMER.] When a motor vehicle is brought by a consumer to a 
  2.6   dealer for repair or maintenance, the dealer is required to 
  2.7   determine whether a manufacturer recall for vehicle repair or 
  2.8   replacement is available and applicable for that vehicle.  The 
  2.9   dealer must inform the consumer that the consumer's vehicle or 
  2.10  vehicle parts may be repaired or replaced pursuant to the recall.
  2.11     Sec. 2.  [EFFECTIVE DATE.] 
  2.12     Section 1 is effective January 1, 2003.
