  1.1                          A bill for an act 
  1.2             relating to professions; codifying the board of 
  1.3             electricity's rules on electrical inspection fees; 
  1.4             proposing coding for new law in Minnesota Statutes, 
  1.5             chapter 326; repealing Minnesota Rules, part 3800.3810.
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  [326.2441] [INSPECTION FEE SCHEDULE.] 
  1.8      Subdivision 1.  [SCHEDULE.] State electrical inspection 
  1.9   fees shall be paid according to subdivisions 2 to 13. 
  1.10     Subd. 2.  [FEE FOR EACH SEPARATE INSPECTION.] The minimum 
  1.11  fee for each separate inspection of an installation, 
  1.12  replacement, alteration, or repair is $20. 
  1.13     Subd. 3.  [FEE FOR SERVICES, GENERATORS, OTHER POWER SUPPLY 
  1.14  SOURCES, OR FEEDERS TO SEPARATE STRUCTURES.] The inspection fee 
  1.15  for the installation, addition, alteration, or repair of each 
  1.16  service, change of service, temporary service, generator, other 
  1.17  power supply source, or feeder to a separate structure is: 
  1.18     (1) 0 ampere to and including 400 ampere capacity, $25; 
  1.19     (2) 401 ampere to and including 800 ampere capacity, $50; 
  1.20  and 
  1.21     (3) ampere capacity above 800, $75. 
  1.22     Where multiple disconnects are grouped at a single location 
  1.23  and are supplied by a single set of supply conductors the 
  1.24  cumulative rating of the overcurrent devices shall be used to 
  1.25  determine the supply ampere capacity. 
  2.1      Subd. 4.  [FEE FOR CIRCUITS, FEEDERS, FEEDER TAPS, OR SETS 
  2.2   OF TRANSFORMER SECONDARY CONDUCTORS.] The inspection fee for the 
  2.3   installation, addition, alteration, or repair of each circuit, 
  2.4   feeder, feeder tap, or set of transformer secondary conductors, 
  2.5   including the equipment served, is: 
  2.6      (1) 0 ampere to and including 200 ampere capacity, $5; and 
  2.7      (2) ampere capacity above 200, $10. 
  2.8      Subd. 5.  [LIMITATIONS TO FEES OF SUBDIVISIONS 3 AND 
  2.9   4.] (a) The fee for a one-family dwelling and each dwelling unit 
  2.10  of a two-family dwelling with a supply of up to 500 amperes 
  2.11  where a combination of ten or more sources of supply, feeders, 
  2.12  or circuits are installed, added, altered, repaired, or extended 
  2.13  is $80.  This fee applies to each separate installation for new 
  2.14  dwellings and additions, alterations, or repairs to existing 
  2.15  dwellings and includes not more than two inspections.  The fee 
  2.16  for additional inspections or other installations is that 
  2.17  specified in subdivisions 2 to 4.  The installer may submit fees 
  2.18  for additional inspections when filing the request for 
  2.19  electrical inspection. 
  2.20     (b) The fee for each dwelling unit of a multifamily 
  2.21  dwelling with three to 12 dwelling units is $50 and the fee for 
  2.22  each additional dwelling unit is $25.  These fees include only 
  2.23  inspection of the wiring within individual dwelling units and 
  2.24  the final feeder to that unit.  This limitation is subject to 
  2.25  the following conditions: 
  2.26     (1) the multifamily dwelling is provided with common 
  2.27  service equipment and each dwelling unit is supplied by a 
  2.28  separate feeder.  The fee for multifamily dwelling services or 
  2.29  other power source supplies and all other circuits is that 
  2.30  specified in subdivisions 2 to 4; and 
  2.31     (2) this limitation applies only to new installations for 
  2.32  multifamily dwellings where the majority of the individual 
  2.33  dwelling units are available for inspection during each 
  2.34  inspection trip. 
  2.35     (c) A separate request for electrical inspection form must 
  2.36  be filed for each dwelling unit that is supplied with an 
  3.1   individual set of service entrance conductors.  These fees are 
  3.2   the one-family dwelling rate specified in paragraph (a). 
  3.3      Subd. 6.  [ADDITIONS TO FEES OF SUBDIVISIONS 3 TO 5.] (a) 
  3.4   The fee for the electrical supply for each manufactured home 
  3.5   park lot is $25.  This fee includes the service or feeder 
  3.6   conductors up to and including the service equipment or 
  3.7   disconnecting means.  The fee for feeders and circuits that 
  3.8   extend from the service or disconnecting means is that specified 
  3.9   in subdivision 4. 
  3.10     (b) The fee for each recreational vehicle site electrical 
  3.11  supply equipment is $5.  The fee for recreational vehicle park 
  3.12  services, feeders, and circuits is that specified in 
  3.13  subdivisions 3 and 4. 
  3.14     (c) The fee for each street, parking lot, or outdoor area 
  3.15  lighting standard is $1, and the fee for each traffic signal 
  3.16  standard is $5.  Circuits originating within the standard or 
  3.17  traffic signal controller shall not be used when computing the 
  3.18  fee. 
  3.19     (d) The fee for transformers for light, heat, and power is 
  3.20  $10 for transformers rated up to ten kilovolt-amperes and $20 
  3.21  for transformers rated in excess of ten kilovolt-amperes. 
  3.22     (e) The fee for transformers and electronic power supplies 
  3.23  for electric signs and outline lighting is $5 per unit. 
  3.24     (f) The fee for alarm, communication, remote control, and 
  3.25  signaling circuits or systems, and circuits of less than 50 
  3.26  volts, is 50 cents for each system device or apparatus. 
  3.27     (g) The fee for each separate inspection of the bonding for 
  3.28  a swimming pool, spa, fountain, an equipotential plane for an 
  3.29  agricultural confinement area, or similar installation shall be 
  3.30  $20.  Bonding conductors and connections require an inspection 
  3.31  before being concealed. 
  3.32     (h) The fee for all wiring installed on center pivot 
  3.33  irrigation booms is $40. 
  3.34     (i) The fee for retrofit modifications to existing lighting 
  3.35  fixtures is 25 cents per lighting fixture. 
  3.36     Subd. 7.  [INVESTIGATION FEES:  WORK WITHOUT A REQUEST FOR 
  4.1   ELECTRICAL INSPECTION.] (a) Whenever any work for which a 
  4.2   request for electrical inspection is required by the board has 
  4.3   begun without the request for electrical inspection form being 
  4.4   filed with the board, a special investigation shall be made 
  4.5   before a request for electrical inspection form is accepted by 
  4.6   the board. 
  4.7      (b) An investigation fee, in addition to the full fee 
  4.8   required by subdivisions 1 to 6, shall be paid before an 
  4.9   inspection is made.  The investigation fee is two times the 
  4.10  hourly rate specified in subdivision 10 or the inspection fee 
  4.11  required by subdivisions 1 to 6, whichever is greater, not to 
  4.12  exceed $1,000.  The payment of the investigation fee does not 
  4.13  exempt any person from compliance with all other provisions of 
  4.14  the board rules or statutes nor from any penalty prescribed by 
  4.15  law. 
  4.16     Subd. 8.  [REINSPECTION FEE.] When reinspection is 
  4.17  necessary to determine whether unsafe conditions have been 
  4.18  corrected and the conditions are not the subject of an appeal 
  4.19  pending before the board or any court, a reinspection fee of $20 
  4.20  may be assessed in writing by the inspector. 
  4.21     Subd. 9.  [SUPPLEMENTAL FEE.] When inspections scheduled by 
  4.22  the installer are preempted, obstructed, prevented, or otherwise 
  4.23  not able to be completed as scheduled due to circumstances 
  4.24  beyond the control of the inspector, a supplemental inspection 
  4.25  fee of $20 may be assessed in writing by the inspector. 
  4.26     Subd. 10.  [SPECIAL INSPECTION.] For inspections not 
  4.27  covered in this section, or for requested special inspections or 
  4.28  services, the fee shall be $30 per hour, including travel time, 
  4.29  plus 31 cents per mile traveled, plus the reasonable cost of 
  4.30  equipment or material consumed.  This provision is applicable to 
  4.31  inspection of empty conduits and other jobs as may be determined 
  4.32  by the board.  This fee may also be assessed when installations 
  4.33  are not accessible by roadway and require alternate forms of 
  4.34  transportation.  
  4.35     Subd. 11.  [INSPECTION OF TRANSITORY PROJECTS.] (a) For 
  4.36  inspection of transitory projects including, but not limited to, 
  5.1   festivals, fairs, carnivals, circuses, shows, production sites, 
  5.2   and portable road construction plants, the inspection procedures 
  5.3   and fees are as specified in paragraphs (b) to (i). 
  5.4      (b) The fee for inspection of each generator or other 
  5.5   source of supply is that specified in subdivision 3.  A like fee 
  5.6   is required at each engagement or setup. 
  5.7      (c) In addition to the fee for generators or other sources 
  5.8   of supply, there must be an inspection of all installed feeders, 
  5.9   circuits, and equipment at each engagement or setup at the 
  5.10  hourly rate specified in subdivision 10, with a two-hour minimum.
  5.11     (d) An owner, operator, or appointed representative of a 
  5.12  transitory enterprise including, but not limited to, festivals, 
  5.13  fairs, carnivals, circuses, production companies, shows, 
  5.14  portable road construction plants, and similar enterprises shall 
  5.15  notify the board of its itinerary or schedule and make 
  5.16  application for initial inspection a minimum of 14 days before 
  5.17  its first engagement or setup.  An owner, operator, or appointed 
  5.18  representative of a transitory enterprise who fails to notify 
  5.19  the board 14 days before its first engagement or setup may be 
  5.20  subject to the investigation fees specified in subdivision 7.  
  5.21  The owner, operator, or appointed representative shall request 
  5.22  inspection and pay the inspection fee for each subsequent 
  5.23  engagement or setup at the time of the initial inspection.  For 
  5.24  subsequent engagements or setups not listed on the itinerary or 
  5.25  schedule submitted to the board and where the board is not 
  5.26  notified at least 48 hours in advance, a charge of $100 may be 
  5.27  made in addition to all required fees. 
  5.28     (e) Amusement rides, devices, concessions, attractions, or 
  5.29  other units must be inspected at their first appearance of the 
  5.30  year.  The inspection fee is $20 per unit with a supply of up to 
  5.31  60 amperes and $30 per unit with a supply above 60 amperes. 
  5.32     (f) An additional fee at the hourly rate specified in 
  5.33  subdivision 10 must be charged for additional time spent by each 
  5.34  inspector if equipment is not ready or available for inspection 
  5.35  at the time and date specified on the application for initial 
  5.36  inspection or the request for electrical inspection form. 
  6.1      (g) In addition to the fees specified in paragraphs (a) and 
  6.2   (b), a fee of two hours at the hourly rate specified in 
  6.3   subdivision 10 must be charged for inspections required to be 
  6.4   performed on Saturdays, Sundays, holidays, or after regular 
  6.5   business hours. 
  6.6      (h) The fee for reinspection of corrections or supplemental 
  6.7   inspections where an additional trip is necessary may be 
  6.8   assessed as specified in subdivision 8. 
  6.9      (i) The board may retain the inspection fee when an owner, 
  6.10  operator, or appointed representative of a transitory enterprise 
  6.11  fails to notify the board at least 48 hours in advance of a 
  6.12  scheduled inspection that is canceled. 
  6.13     Subd. 12.  [HANDLING FEE.] The handling fee to pay the cost 
  6.14  of printing and handling of the form requesting an inspection is 
  6.15  $1. 
  6.16     Subd. 13.  [NATIONAL ELECTRICAL CODE USED FOR 
  6.17  INTERPRETATION OF PROVISIONS.] For purposes of interpretation of 
  6.18  this section and Minnesota Rules, chapter 3800, the most 
  6.19  recently adopted edition of the National Electrical Code shall 
  6.20  be prima facie evidence of the definitions, interpretations, and 
  6.21  scope of words and terms used.  
  6.22     Sec. 2.  [INSTRUCTION TO REVISOR.] 
  6.23     The revisor shall change references in Minnesota Rules from 
  6.24  Minnesota Rules, part 3800.3810, to Minnesota Statutes, section 
  6.25  326.2441. 
  6.26     Sec. 3.  [REPEALER.] 
  6.27     Minnesota Rules, part 3800.3810, is repealed.
