A bill for an act
relating to local government; authorizing town boards to require sewer and water
connections on certain property; amending Minnesota Statutes 2008, section
366.01, by adding a subdivision.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2008, section 366.01, is amended by adding a
subdivision to read:

new text begin If a dwelling or commercial establishment
abuts or is adjacent to a town-operated sewer or water main, the town board may by
ordinance require the owner of the abutting or adjacent property to install water and
sanitary waste facilities in the dwelling or commercial establishment and connect it with
the town-operated sewer and water main. If the property owner fails to install the required
facilities and connections within the time required by the ordinance, the town board may
provide for the installation of the facilities and connections under this section by the
town and for the collection of the cost to the town of the installation of the facilities and
connections as a special assessment against the property.
