A bill for an act
relating to gambling; clarifying the definitions of gambling device and video
game of chance; amending Minnesota Statutes 2008, section 609.75, by adding a
subdivision.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2008, section 609.75, is amended by adding a
subdivision to read:

new text begin What are not gambling devices or video games of chance. new text end

new text begin A device is
not a "gambling device" or a "video game of chance" if it:

new text begin (1) is used primarily for entertainment;
new text end

new text begin (2) only awards replays or prizes contained within the device, excluding cash, coins,
currency, money, or any similar medium of exchange; and

new text begin (3) does not include a knockoff switch, a remote key, or a wireless device for the
purpose of erasing credits.

new text begin For purposes of this subdivision, "entertainment" means activity undertaken for the
purpose of amusement and enjoyment of the activity itself and not as a means of betting or
gambling.
