  1.1                          A bill for an act 
  1.2             relating to government data practices; providing for 
  1.3             victim support data; amending Minnesota Statutes 2000, 
  1.4             section 13.80. 
  1.5   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.6      Section 1.  Minnesota Statutes 2000, section 13.80, is 
  1.7   amended to read: 
  1.8      13.80 [DOMESTIC ABUSE DATA.] 
  1.9      Subdivision 1.  [DOMESTIC ABUSE ACT DATA.] All government 
  1.10  data on individuals which is collected, created, received or 
  1.11  maintained by police departments, sheriffs' offices or clerks of 
  1.12  court pursuant to the Domestic Abuse Act, section 518B.01, are 
  1.13  classified as confidential data, pursuant to section 13.02, 
  1.14  subdivision 3, until a temporary court order made pursuant to 
  1.15  subdivision 5 or 7 of section 518B.01 is executed or served upon 
  1.16  the data subject who is the respondent to the action.  
  1.17     Subd. 2.  [VICTIM SUPPORT SERVICES DATA.] This subdivision 
  1.18  governs data collected, used, or maintained by a government 
  1.19  entity that provides emergency shelter or support services for 
  1.20  domestic abuse victims.  Personal history information and data 
  1.21  from which the identity or location of a domestic abuse victim 
  1.22  may be determined is classified as private data but may be 
  1.23  released without the data subject's consent to authorized law 
  1.24  enforcement officers, court personnel, or prosecuting attorneys 
  1.25  for the purpose of investigating, prosecuting, and sentencing in 
  2.1   domestic abuse cases.
