  1.1                          A bill for an act 
  1.2             relating to crime prevention; reinstating the domestic 
  1.3             abuse investigation fee; amending Minnesota Statutes 
  1.4             2000, section 609.2244, by adding a subdivision. 
  1.5   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.6      Section 1.  Minnesota Statutes 2000, section 609.2244, is 
  1.7   amended by adding a subdivision to read: 
  1.8      Subd. 5.  [DOMESTIC ABUSE INVESTIGATION FEE.] When the 
  1.9   court sentences a person convicted of an offense described in 
  1.10  subdivision 1, the court shall impose a domestic abuse 
  1.11  investigation fee of at least $50 but not more than $125.  This 
  1.12  fee must be imposed whether the sentence is executed, stayed, or 
  1.13  suspended.  The court may not waive payment or authorize payment 
  1.14  of the fee in installments unless it makes written findings on 
  1.15  the record that the convicted person is indigent or that the fee 
  1.16  would create undue hardship for the convicted person or that 
  1.17  person's immediate family.  The person convicted of the offense 
  1.18  and ordered to pay the fee shall pay the fee to the county 
  1.19  corrections department or other designated agencies conducting 
  1.20  the investigation.  When the court orders the convicted person 
  1.21  to also pay the costs of domestic abuse counseling or 
  1.22  educational programs, restitution, or a criminal fine, the court 
  1.23  shall order the person to pay the entire amount owed before the 
  1.24  person pays the fee imposed under this subdivision. 
  1.25     Sec. 2.  [EFFECTIVE DATE.] 
  2.1      Section 1 is effective July 1, 2002, and applies to 
  2.2   offenders sentenced on or after that date.
