  1.1                          A bill for an act 
  1.2             relating to real property; specifying limitation of 
  1.3             actions based on breach of statutory home warranties; 
  1.4             amending Minnesota Statutes 2000, section 541.051, 
  1.5             subdivision 4. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  Minnesota Statutes 2000, section 541.051, 
  1.8   subdivision 4, is amended to read: 
  1.9      Subd. 4.  [STATUTORY OR EXPRESS WARRANTIES.] (a) This 
  1.10  section shall not apply to actions based on breach of the 
  1.11  statutory warranties set forth in section 327A.02, or to actions 
  1.12  based on breach of an express written warranty, provided such 
  1.13  actions shall be brought within two years of the discovery of 
  1.14  the breach and as otherwise provided in this subdivision. 
  1.15     (b) Except where fraud is involved, no action by a vendee 
  1.16  may be brought against a vendor for defects discovered after one 
  1.17  year from the date of a completed dwelling for defects described 
  1.18  in section 327A.02, subdivision 1, paragraph (a).  
  1.19     (c) Except where fraud is involved, no action by a vendee 
  1.20  may be brought against a vendor for defects discovered after two 
  1.21  years from the date of a completed dwelling for defects 
  1.22  described in section 327A.02, subdivision 1, paragraph (b).  
  1.23     (d) Except where fraud is involved, no action by a vendee 
  1.24  may be brought against a vendor for defects discovered after ten 
  1.25  years from the date of a completed dwelling for defects 
  2.1   described in section 327A.02, subdivision 1, paragraph (c).
