A bill for an act
relating to occupations licensed by the state; providing a deferral of payment
of fees under certain conditions; amending Minnesota Statutes 2008, section
326.105; proposing coding for new law in Minnesota Statutes, chapter 326B.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:
Minnesota Statutes 2008, section 326.105, is amended to read:
The fee for licensure or renewal of licensure as an architect, professional engineer,
land surveyor, landscape architect, or geoscience professional is $120 per biennium.
The fee for certification as a certified interior designer or for renewal of the certificate
is $120 per biennium. The fee for an architect applying for original certification as a
certified interior designer is $50 per biennium. The initial license or certification fee for
all professions is $120. The renewal fee shall be paid biennially on or before June 30 of
each even-numbered year. The renewal fee, when paid by mail, is not timely paid unless
it is postmarked on or before June 30 of each even-numbered year. The application fee
is $25 for in-training applicants and $75 for professional license applicants.new text begin The board
may provide up to a one-year deferral of payment of a fee for issuance of a license or a
certificate to an individual who can demonstrate to the board's satisfaction that payment
of the fee would impose an undue burden or hardship on the individual. The board shall
determine what constitutes undue burden or hardship and prescribe the manner and form
under which a deferral of payment is allowed under this section.

The commissioner may provide up to a one-year deferral of payment of a fee only
for issuance of a license or registration required under sections 326B.33, subdivision 19,
326B.49, subdivision 1, 326B.58, 326B.815, 326B.921, subdivisions 4 and 7, 326B.986,
subdivision 5, and fees required under section 326B.89, subdivision 3, to an individual
who can demonstrate to the commissioner's satisfaction that payment of the fee would
impose an undue burden or hardship on the individual. The commissioner shall determine
what constitutes undue burden or hardship and prescribe the manner and form under
which a deferral of payment is allowed under this section.
