A bill for an act
relating to higher education; requiring the commissioner of the Office of Higher
Education to enter into a contract if an information technology project exceeds a
certain cost threshold; proposing coding for new law in Minnesota Statutes, chapter
136A.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

TECHNOLOGY PROJECTS.

new text begin The commissioner must enter into a contract with one or more vendors for the
development and completion of an information and telecommunications technology project
if the total expected cost is more than $1,000,000. The contract must be solicited, awarded,
and executed according to the requirements of chapter 16C. Notwithstanding section 16C.08,
subdivision 2, a competitive proposal process must be used for professional and technical
services related to a project subject to this section, regardless of whether a current state
agency employee is able and available to perform the services called for by the contract.
The state chief information officer may submit a proposal in response to a solicitation
required by this section.
