  1.1                          A bill for an act 
  1.2             relating to gambling; prohibiting location of 
  1.3             state-operated or state-licensed gambling facility in 
  1.4             a city in which the governing body has adopted a 
  1.5             resolution of disapproval.  
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  [CASINO LOCATION; LOCAL VETO.] 
  1.8      Subdivision 1.  [DEFINITION.] For purposes of this section 
  1.9   "gambling facility" means a facility operated or licensed by the 
  1.10  state at which games commonly considered to be casino games are 
  1.11  conducted.  Gambling facility does not include (1) a racetrack 
  1.12  licensed under Minnesota Statutes, chapter 240, or (2) a 
  1.13  facility at which the only gambling conducted is lawful gambling 
  1.14  licensed under Minnesota Statutes, chapter 349. 
  1.15     Subd. 2.  [LOCAL RESOLUTION OF DISAPPROVAL.] The governing 
  1.16  body of a home rule charter or statutory city may by resolution 
  1.17  disapprove the location of a gambling facility within the city.  
  1.18  No agency of the state may operate or license the operation of a 
  1.19  gambling facility that is or would be located in a city in which 
  1.20  the governing body has passed a resolution of disapproval. 
  1.21     [EFFECTIVE DATE.] This section is effective the day 
  1.22  following final enactment.
