  1.1                          A bill for an act 
  1.2             relating to motor carriers; exempting certain drivers 
  1.3             from requirement to maintain a record of duty status; 
  1.4             amending Minnesota Statutes 1999 Supplement, section 
  1.5             221.0314, subdivision 9a. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  Minnesota Statutes 1999 Supplement, section 
  1.8   221.0314, subdivision 9a, is amended to read: 
  1.9      Subd. 9a.  [HOURS OF SERVICE EXEMPTIONS.] (a) The federal 
  1.10  regulations incorporated in subdivision 9 for maximum driving 
  1.11  and on-duty time do not apply to drivers engaged in the 
  1.12  interstate or intrastate transportation of: 
  1.13     (1) agricultural commodities or farm supplies for 
  1.14  agricultural purposes in Minnesota during the planting and 
  1.15  harvesting seasons from March 15 to December 15 of each year; or 
  1.16     (2) sugar beets during the harvesting season for sugar 
  1.17  beets from September 1 to May 15 of each year; 
  1.18  if the transportation is limited to an area within a 
  1.19  100-air-mile radius from the source of the commodities or the 
  1.20  distribution point for the farm supplies. 
  1.21     (b) The federal regulations incorporated in subdivision 9 
  1.22  for driver's record of duty status do not apply to a driver 
  1.23  described in Code of Federal Regulations, title 49, section 
  1.24  395.1, paragraphs (e)(1) to (e)(4), if the motor carrier that 
  1.25  employs the driver conforms with Code of Federal Regulations, 
  2.1   title 49, section 395.1, paragraph (e)(5). 
  2.2      Sec. 2.  [EFFECTIVE DATE.] 
  2.3      Section 1 is effective June 1, 2000.
