  1.1                          A bill for an act 
  1.2             relating to commerce; providing an alternative civil 
  1.3             penalty in certain antitrust cases; amending Minnesota 
  1.4             Statutes 2000, section 325D.56, subdivision 1. 
  1.5   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.6      Section 1.  Minnesota Statutes 2000, section 325D.56, 
  1.7   subdivision 1, is amended to read: 
  1.8      Subdivision 1.  (a) Except as provided in paragraph (b), 
  1.9   any person who is found to have violated sections 325D.49 to 
  1.10  325D.66, shall be subject to a civil penalty of not more than 
  1.11  $50,000.  Any person who fails to comply with a final judgment 
  1.12  or decree rendered by a court of this state issued for a 
  1.13  violation of sections 325D.49 to 325D.66, shall be subject to a 
  1.14  civil penalty of not more than $100,000. 
  1.15     (b) If the amount awarded in damages under section 325D.57 
  1.16  in any civil action exceeds $250,000, the civil penalty imposed 
  1.17  shall be the amount provided under United States Code, title 15, 
  1.18  section 1.
