A bill for an act
relating to environment; providing for refund of certain permit application fees;
amending Minnesota Statutes 2020, section 116.03, by adding a subdivision.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2020, section 116.03, is amended by adding a subdivision
to read:

new text begin Permit application fees; refund. new text end

new text begin If the commissioner does not issue or deny
a tier 2 permit within the earlier of 150 days after the commissioner determines that a permit
application is complete or 180 days after the permit application is submitted, the
commissioner must refund to the permit applicant any fees that are collected by the
commissioner under section 116.07, subdivision 4d, and related to the permit application.
After refunding fees under this subdivision, the commissioner must act on the permit
application without collecting any additional fees.
