  1.1                          A bill for an act 
  1.2             relating to telecommunications; prohibiting certain 
  1.3             practices and requiring certain training for 911 calls 
  1.4             in multiline telephone systems; proposing coding for 
  1.5             new law in Minnesota Statutes, chapter 403. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  [403.15] [MULTILINE TELEPHONE SYSTEM.] 
  1.8      Subdivision 1.  [DEFINITIONS.] For the purposes of this 
  1.9   section:  
  1.10     (a) "Multiline telephone system" means a telephone system 
  1.11  comprised of common control units, telephones, and control 
  1.12  hardware and software.  A multiline telephone system includes 
  1.13  network and premises-based systems, such as Centrex, PBX, 
  1.14  Hybrid, and Key telephone systems as defined by the Federal 
  1.15  Communications Commission under part 68 requirements, and 
  1.16  includes systems owned or leased by governmental agencies and 
  1.17  nonprofit entities as well as for-profit businesses.  
  1.18     (b) "End user" means the person making telephone calls, 
  1.19  including 911 calls, from a multiline telephone system providing 
  1.20  telephone service to the person's place of employment, school, 
  1.21  permanent residence, temporary residence, or temporary lodging 
  1.22  facility.  
  1.23     (c) "System operator" means the person who has 
  1.24  responsibility to the end user to coordinate telephone line 
  1.25  number and address location assignments.  
  2.1      (d) "Emergency response location" means a location to which 
  2.2   a 911 emergency response team may be dispatched, described 
  2.3   specifically enough to provide a reasonable opportunity for the 
  2.4   emergency response team to quickly locate a caller within it.  
  2.5      Subd. 2.  [BLOCKING OF 911 DIALING PROHIBITED.] A system 
  2.6   operator shall not block an end user from accessing minimum 911 
  2.7   service. 
  2.8      Subd. 3.  [DISCLOSURE OF 911 DIALING AND CALLING 
  2.9   CAPABILITIES.] (a) When the method of dialing a local call from 
  2.10  a multiline telephone system telephone requires the dialing of 
  2.11  an additional digit to access the public switched network, 
  2.12  system operators shall provide written information and periodic 
  2.13  training to their end users regarding the proper method of 
  2.14  dialing 911 from a multiline telephone system telephone in an 
  2.15  emergency.  System operators who do not provide the call-back 
  2.16  number and location for the 911 caller or emergency response 
  2.17  location to enhanced 911 systems shall disclose that fact in 
  2.18  writing to their end users and instruct them to provide their 
  2.19  telephone number and exact location when calling 911.  
  2.20     (b) The written information required in paragraph (a) must 
  2.21  be approved by the fire marshal, building inspector, or other 
  2.22  designated appropriate authority.  The information must be 
  2.23  provided to each individual end user at the time of hiring in 
  2.24  the case of an employer, at the time of registration in the case 
  2.25  of a private or public school, at the time of occupancy in the 
  2.26  case of a residence or temporary lodging facility, and annually 
  2.27  thereafter.  Whenever possible, the information must also be 
  2.28  placed on cards or stickers on or next to the multiline 
  2.29  telephone system telephone.  
  2.30     Subd. 4.  [LOCAL REGULATION.] Nothing in this section 
  2.31  preempts enforcement or precludes adoption of municipal or 
  2.32  county ordinances regulating multiline telephone systems.
