  1.1                          A bill for an act 
  1.2             relating to the metropolitan council; requiring the 
  1.3             metropolitan council to adopt a housing policy plan; 
  1.4             prohibiting the council from providing certain new or 
  1.5             improved facilities for municipalities not 
  1.6             participating in the metropolitan livable communities 
  1.7             program; requiring the council to negotiate revised 
  1.8             housing goals upon adoption of the council's housing 
  1.9             policy plan; amending Minnesota Statutes 1998, section 
  1.10            473.254, subdivisions 1 and 2; proposing coding for 
  1.11            new law in Minnesota Statutes, chapter 473. 
  1.12  BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.13     Section 1.  [473.143] [HOUSING POLICY PLAN.] 
  1.14     The metropolitan council shall adopt by December 31, 2000, 
  1.15  a housing policy plan that provides for each municipality in the 
  1.16  metropolitan area to provide its fair share of housing 
  1.17  affordable to families at 30, 50, and 80 percent of the 
  1.18  metropolitan area median household income. 
  1.19     Sec. 2.  Minnesota Statutes 1998, section 473.254, 
  1.20  subdivision 1, is amended to read: 
  1.21     Subdivision 1.  [PARTICIPATION.] (a) By November 15 of each 
  1.22  year, a municipality may elect to participate in the local 
  1.23  housing incentive account program.  If a municipality does not 
  1.24  elect to participate for the year, it is not subject to this 
  1.25  section.  For purposes of this section, municipality means a 
  1.26  municipality electing to participate in the local housing 
  1.27  incentive account program, unless the context indicates 
  1.28  otherwise. 
  2.1      (b) A municipality that elects to participate may receive 
  2.2   grants or loans from the tax base revitalization account, 
  2.3   livable communities demonstration account, the inclusionary 
  2.4   housing account, or the local housing incentive account.  A 
  2.5   municipality that does not participate is not eligible to 
  2.6   receive a grant under sections 116J.551 to 116J.557.  The 
  2.7   council, when making discretionary funding decisions, shall give 
  2.8   consideration priority to a municipality's 
  2.9   participation municipalities participating in the local housing 
  2.10  incentives program and that have met their affordable and 
  2.11  life-cycle housing goals for the previous year or that are 
  2.12  making significant progress toward their goals.  The council may 
  2.13  not recommend or provide for new highways, new or improved 
  2.14  highway access, or increased sewer capacity for a municipality 
  2.15  that does not participate in the local housing incentives 
  2.16  program.  
  2.17     Sec. 3.  Minnesota Statutes 1998, section 473.254, 
  2.18  subdivision 2, is amended to read: 
  2.19     Subd. 2.  [AFFORDABLE, LIFE-CYCLE GOALS.] The council shall 
  2.20  negotiate with each municipality to establish affordable and 
  2.21  life-cycle housing goals for that municipality that are 
  2.22  consistent with and promote the policies of the metropolitan 
  2.23  council as provided in the adopted metropolitan development 
  2.24  guide.  The council shall adopt, by resolution after a public 
  2.25  hearing, the negotiated affordable and life-cycle housing goals 
  2.26  for each municipality by January 15, 1996.  By June 30, 1996, 
  2.27  each municipality shall identify to the council the actions it 
  2.28  plans to take to meet the established housing goals.  Upon the 
  2.29  adoption of the housing policy plan under section 473.143, the 
  2.30  council shall review each municipality's goals under this 
  2.31  section and, if necessary to meet the requirements of the 
  2.32  housing policy plan, negotiate revised goals with affected 
  2.33  municipalities. 
  2.34     Sec. 4.  [APPLICATION.] 
  2.35     This act applies in the counties of Anoka, Carver, Dakota, 
  2.36  Hennepin, Ramsey, Scott, and Washington. 
  3.1      Sec. 5.  [EFFECTIVE DATE.] 
  3.2      Sections 1 to 4 are effective the day after their final 
  3.3   enactment.
