  1.1                          A bill for an act 
  1.2             relating to transportation; directing commissioner of 
  1.3             transportation to obtain waiver from federal 
  1.4             government allowing Minnesota to withdraw from 
  1.5             participation in federal highway funding programs; 
  1.6             adjusting state motor fuel tax rate; transferring 
  1.7             transportation planning authority from metropolitan 
  1.8             council to department of transportation. 
  1.9   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.10     Section 1.  [WAIVER.] 
  1.11     The commissioner of transportation shall take all actions 
  1.12  necessary to obtain a waiver from the federal government to 
  1.13  enable the state of Minnesota to discontinue participating in 
  1.14  programs authorized by the Transportation Equity Act for the 
  1.15  21st Century, Public Law Number 105-178, and to discontinue 
  1.16  remitting motor fuel tax revenues, highway user tax revenues, 
  1.17  and any other funds to the federal government that would be 
  1.18  deposited in the highway trust fund or otherwise used to carry 
  1.19  out provisions of the Transportation Equity Act for the 21st 
  1.20  Century. 
  1.21     Sec. 2.  [ADJUSTMENT IN MOTOR FUEL TAX RATES.] 
  1.22     The commissioner of revenue shall adjust, by proportionate 
  1.23  increases, the rate of state tax on petroleum and other fuels so 
  1.24  that additional tax collections equal the amount of federal-aid 
  1.25  highway funding received by this state in the fiscal year before 
  1.26  the waiver described in section 1 is granted. 
  1.27     Sec. 3.  [TRANSFER OF TRANSPORTATION PLANNING POWERS.] 
  2.1      All powers, duties, and functions relating to 
  2.2   transportation planning previously vested in or imposed on the 
  2.3   metropolitan council by law are transferred to, vested in, and 
  2.4   imposed on the commissioner of transportation.
