  1.1                          A bill for an act 
  1.2             relating to transportation; creating a right-of-way 
  1.3             acquisition loan fund; specifying uses for the fund; 
  1.4             providing for transfers to the fund; appropriating 
  1.5             money; proposing coding for new law in Minnesota 
  1.6             Statutes, chapter 174. 
  1.7   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.8      Section 1.  [174.53] [RIGHT-OF-WAY ACQUISITION LOAN FUND.] 
  1.9      Subdivision 1.  [FUND CREATED.] A right-of-way acquisition 
  1.10  loan fund is created in the state treasury.  The fund consists 
  1.11  of money allocated to the fund under subdivision 2. 
  1.12     Subd. 2.  [GENERAL FUND TRANSFER; APPROPRIATION.] The 
  1.13  commissioner of finance shall annually transfer $....... from 
  1.14  the general fund to the right-of-way acquisition loan fund.  
  1.15  Money in the fund is annually appropriated to the commissioner 
  1.16  of transportation for expenditure as specified in subdivision 
  1.17  3.  Any part of this appropriation not spent as of June 30 each 
  1.18  year cancels to the general fund. 
  1.19     Subd. 3.  [USES OF THE FUND.] (a) Money in the fund may be 
  1.20  used to make grants to road authorities for expenses of 
  1.21  right-of-way acquisition meeting the following criteria: 
  1.22     (1) the right-of-way acquisition is necessary for the 
  1.23  improvement of a local road that directly affects the 
  1.24  performance of an adjacent trunk highway corridor; and 
  1.25     (2) the cost of the right-of-way is greater than 20 percent 
  1.26  of the amount levied in that year by the municipality purchasing 
  2.1   the right-of-way.  
  2.2      (b) The amount of the grant may not exceed the total cost 
  2.3   of the right-of-way, minus 20 percent of the municipality's 
  2.4   annual levy.  Any money received by the municipality from a 
  2.5   subsequent sale of the purchased property must first be repaid 
  2.6   to the fund up to the amount of the original grant.
