  1.1                          A bill for an act 
  1.2             relating to agriculture; providing an additional 
  1.3             exception to the sale of certain dairy products below 
  1.4             cost; amending Minnesota Statutes 1998, section 32.72, 
  1.5             subdivision 2. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  Minnesota Statutes 1998, section 32.72, 
  1.8   subdivision 2, is amended to read: 
  1.9      Subd. 2.  [EXCEPTIONS.] The minimum processor, wholesaler, 
  1.10  and retailer prices of subdivision 1 do not apply:  
  1.11     (i) to a sale complying with section 325D.06, clauses (1) 
  1.12  to (4); 
  1.13     (ii) to a retailer giving away selected class I and class 
  1.14  II dairy products free if the customer is not required to make a 
  1.15  purchase; or 
  1.16     (iii) to a processor, wholesaler, or retailer giving away 
  1.17  selected class I and class II dairy products free or at a 
  1.18  reduced cost to a bona fide charity; or 
  1.19     (iv) to a retailer who sells selected class I and class II 
  1.20  dairy products at a price below the retailer's basic cost at any 
  1.21  time after 8:00 a.m. on the day preceding the date of the open 
  1.22  dating stamp on the product container.
