A bill for an act
relating to transportation; establishing public hearing requirements for certain
trunk highway and transit projects; amending Minnesota Statutes 2022, section
473.399, by adding a subdivision; proposing coding for new law in Minnesota
Statutes, chapter 161.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

new text begin (a) For purposes of this section, the following terms have
the meanings given.

new text begin (b) "Final layout" has the meaning given in section 161.162, subdivision 2.

new text begin (c) "Project lead" means the commissioner, project sponsor, or other entity designated
by the commissioner that manages or leads performance of a salient project.

new text begin (d) "Salient project" means a project for trunk highway construction or reconstruction
that is:

new text begin (1) subject to municipal approval under sections 161.162 to 161.167;
new text end

new text begin (2) subject to the requirements under section 160.165; or
new text end

new text begin (3) a major highway project, as defined in section 174.56, subdivision 1.

new text begin (a) Prior to completion of the final layout for a salient project,
the project lead must solicit and consider public input. The project lead must hold at least
one public hearing and permit interested persons to present comments and views on the
project.

new text begin (b) At least 30 days before a hearing, the project lead must provide notice of the hearing
in a newspaper or other periodical of general circulation in the area of the project. The notice
must state the date, time, and place of the hearing and that individuals have an opportunity
to present their comments and views on the project.

Sec. 2.

Minnesota Statutes 2022, section 473.399, is amended by adding a subdivision to
read:

new text begin (a) For purposes of this subdivision, the following terms have
the meanings given:

new text begin (1) "guideway" has the meaning given in section 473.4485, subdivision 1; and

new text begin (2) "project lead" means the Metropolitan Council or the responsible authority, as defined
in section 473.3993, subdivision 4.

new text begin (b) Prior to selection of a locally preferred alternative for a guideway project, the project
lead must solicit and consider public input. The project lead must hold at least one public
hearing and permit interested persons to present comments and views on the project.

new text begin (c) At least 30 days before a hearing, the project lead must provide notice of the hearing
in a newspaper or other periodical of general circulation in the area of the project. The notice
must state the date, time, and place of the hearing and that individuals have an opportunity
to present their comments and views on the project.
