  1.1                          A bill for an act 
  1.2             relating to human services; expanding the SAIL program 
  1.3             and requiring additional SAIL initiatives; modifying 
  1.4             the administration of the congregate housing services 
  1.5             projects; appropriating money; amending Minnesota 
  1.6             Statutes 1998, sections 256.9751; and 256B.0917, by 
  1.7             adding a subdivision. 
  1.8   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.9      Section 1.  Minnesota Statutes 1998, section 256.9751, is 
  1.10  amended to read: 
  1.11     256.9751 [CONGREGATE HOUSING ON-SITE COORDINATION (OSC) 
  1.12  SERVICES PROJECTS.] 
  1.13     Subdivision 1.  [DEFINITIONS.] For the purposes of this 
  1.14  section, the following terms have the meanings given them.  
  1.15     (a)  [CONGREGATE HOUSING.] "Congregate housing" means 
  1.16  federally or locally subsidized housing and nonsubsidized low- 
  1.17  and moderate-income multifamily housing units which may not have 
  1.18  common areas for activities and for serving food, designed for 
  1.19  the elderly, consisting of private apartments and common areas 
  1.20  which can be used for activities and for serving meals. 
  1.21     (b)  [CONGREGATE HOUSING ON-SITE COORDINATION SERVICES 
  1.22  PROJECTS.] "Congregate housing On-site coordination services 
  1.23  project" means a project in which services are or could be made 
  1.24  available to older persons age 55 or older who live 
  1.25  in subsidized housing a designated service area and which helps 
  1.26  delay or prevent nursing home placement them remain 
  2.1   independent.  To be considered a congregate housing an on-site 
  2.2   coordination services project, a project must have:  (1) an 
  2.3   on-site coordinator, and; (2) a plan for assuring the 
  2.4   availability of one meal per day, seven days a week, for each 
  2.5   elderly participant in need who needs a meal to continue to live 
  2.6   independently; and (3) an approved designated service area.  
  2.7      (c)  [ON-SITE COORDINATOR.] "On-site coordinator" means a 
  2.8   person who works on-site in a building or buildings designated 
  2.9   service area and who serves as a contact for older persons who 
  2.10  need services, support, and assistance in order to delay or 
  2.11  prevent nursing home placement help them remain independent.  
  2.12     (d)  [CONGREGATE HOUSING ON-SITE COORDINATION SERVICES 
  2.13  PROJECT PARTICIPANTS OR PROJECT PARTICIPANTS.] "Congregate 
  2.14  housing On-site coordination services project participants" or 
  2.15  "project participants" means elderly persons 60 55 years old or 
  2.16  older, who are currently residents of, or who are applying for 
  2.17  residence in housing sites, planning to move into a designated 
  2.18  service area and who need support services to remain independent.
  2.19     (e)  [DESIGNATED SERVICE AREA OR DSA.] "Designated service 
  2.20  area" or "DSA" means a geographic area in which on-site 
  2.21  coordination services will be provided.  The designated service 
  2.22  area must have a concentration of residents who are 55 years of 
  2.23  age or older.  The DSA may include on-site coordination services 
  2.24  projects that exist within the designated service area. 
  2.25     Subd. 3.  [GRANT PROGRAM.] The Minnesota board on aging 
  2.26  commissioner shall establish a congregate housing an on-site 
  2.27  coordination services grant program which demonstration project 
  2.28  that is coordinated with existing seniors' agenda for 
  2.29  independent living (SAIL) projects as defined in section 
  2.30  256B.0917, that will enable communities and neighborhoods to 
  2.31  provide on-site coordinators to serve as a an arranger or 
  2.32  developer contact for older persons who need services and 
  2.33  support, and assistance to access services in order to delay or 
  2.34  prevent nursing home placement and to help them remain 
  2.35  independent. 
  2.36     Subd. 4.  [USE OF GRANT FUNDS.] Grant funds shall be used 
  3.1   to develop and fund on-site coordinator positions.  Grant funds 
  3.2   shall not be used to duplicate existing funds, to modify 
  3.3   buildings, or to purchase equipment.  
  3.4      Subd. 5.  [GRANT ELIGIBILITY.] A public or nonprofit agency 
  3.5   or housing unit may apply for funds to provide a coordinator for 
  3.6   congregate housing on-site coordination services to an 
  3.7   identified population of frail elderly persons in a subsidized 
  3.8   multiunit apartment building or buildings in a 
  3.9   community designated service area.  The board commissioner shall 
  3.10  give preference to applicants that meet the requirements of this 
  3.11  section, and that have a common dining site in the designated 
  3.12  service area.  A local match may be required.  State money 
  3.13  received may also be used to match federal money allocated 
  3.14  for congregate housing on-site coordination services.  Grants 
  3.15  shall be awarded to urban and rural sites. 
  3.16     Subd. 6.  [CRITERIA FOR SELECTION.] The Minnesota board on 
  3.17  aging commissioner shall select projects under this section 
  3.18  according to the following criteria: 
  3.19     (1) the extent to which the proposed project assists older 
  3.20  persons to age-in-place to prevent or delay nursing home 
  3.21  placement; 
  3.22     (2) the extent to which the proposed project identifies the 
  3.23  needs of project participants; 
  3.24     (3) the extent to which the proposed project identifies how 
  3.25  the on-site coordinator will help meet the needs of project 
  3.26  participants; 
  3.27     (4) the extent to which the proposed project plan assures 
  3.28  the availability of one meal a day, seven days a week, for each 
  3.29  elderly participant in need in the designated service area; 
  3.30     (5) the extent to which the proposed project demonstrates 
  3.31  involvement of participants, communities, and family members in 
  3.32  the project; and 
  3.33     (6) the extent to which the proposed project demonstrates 
  3.34  involvement of housing providers community agencies and public 
  3.35  and private service agencies, including area agencies on aging. 
  3.36  A designated service area with a senior dining program may be 
  4.1   given preference. 
  4.2      Subd. 7.  [GRANT APPLICATIONS.] The Minnesota board on 
  4.3   aging commissioner shall request proposals for grants and award 
  4.4   grants using the criteria in subdivision 6.  Grant applications 
  4.5   shall include: 
  4.6      (1) documentation of the need for congregate on-site 
  4.7   coordination services in the DSA so the residents can remain 
  4.8   independent; 
  4.9      (2) a description of the resources, such as social services 
  4.10  and health services, that will be available in the DSA community 
  4.11  to provide the necessary support services; 
  4.12     (3) a description of the target population, as defined in 
  4.13  subdivision 1, paragraph (d); 
  4.14     (4) a performance plan that includes written performance 
  4.15  objectives, outcomes, timelines, and the procedure the grantee 
  4.16  will use to document and measure success in meeting the 
  4.17  objectives; and 
  4.18     (5) letters of support from appropriate public and private 
  4.19  agencies and organizations, such as area agencies on aging and 
  4.20  county human service departments that demonstrate an intent to 
  4.21  work with and coordinate with the agency requesting a grant.  
  4.22     Subd. 8.  [REPORT.] By January 1, 1993, the Minnesota board 
  4.23  on aging shall submit a report to the legislature evaluating the 
  4.24  programs.  The report must document the project costs and 
  4.25  outcomes that helped delay or prevent nursing home placement.  
  4.26  The report must describe steps taken for quality assurance and 
  4.27  must also include recommendations based on the project 
  4.28  findings.  The commissioner shall collect data on a quarterly 
  4.29  basis on the number of persons served and other factors relating 
  4.30  to the goals, activities, and accomplishments of the projects.  
  4.31  The commissioner shall provide this data in summary form to the 
  4.32  legislature in annual reports, due January 1, 2000, and each 
  4.33  January 1 thereafter.  The annual reports must also include 
  4.34  recommendations based on project findings. 
  4.35     Subd. 9.  [TECHNICAL ASSISTANCE.] The commissioner may 
  4.36  provide technical assistance to sponsors of on-site coordination 
  5.1   services programs or may contract or delegate the provision of 
  5.2   technical assistance. 
  5.3      Subd. 10.  [OTHER AGENCIES.] The commissioner may delegate, 
  5.4   use, or employ any federal, state, regional, or local public or 
  5.5   private agency or organization, including organizations of 
  5.6   physically handicapped persons, upon terms the commissioner 
  5.7   deems necessary or desirable, to assist in the exercise of any 
  5.8   of the powers granted in this section. 
  5.9      Sec. 2.  Minnesota Statutes 1998, section 256B.0917, is 
  5.10  amended by adding a subdivision to read: 
  5.11     Subd. 13.  [ADDITIONAL SAIL INITIATIVES.] The commissioner 
  5.12  shall include the following initiatives in the biennial SAIL 
  5.13  plans for fiscal years 2000 and 2001 and fiscal years 2002 and 
  5.14  2003: 
  5.15     (1) programs to strengthen utilization of informal services 
  5.16  and better link those community resources to the formal delivery 
  5.17  system; 
  5.18     (2) programs to build community capacity to serve 
  5.19  hard-to-reach elders by addressing specific language and 
  5.20  cultural barriers; 
  5.21     (3) strategies to integrate the functions of SAIL and 
  5.22  federal Older Americans Act program development activities, as 
  5.23  awarded by the Minnesota board on aging; 
  5.24     (4) programs to implement at least three models of 
  5.25  effective on-site service coordination in housing units and 
  5.26  neighborhoods with large concentrations of older adults as 
  5.27  described in section 256.9751; 
  5.28     (5) a program to apply the SAIL concept to services for 
  5.29  Indian elders living on Minnesota reservations and elderly who 
  5.30  are hard to reach due to language or ethnic barriers; 
  5.31     (6) the development of possible strategies to coordinate 
  5.32  federal Older Americans Act funds, consumer support grants, and 
  5.33  alternative care funds, to provide increased flexibility and 
  5.34  efficiency; 
  5.35     (7) an information and education strategy that supports 
  5.36  regional capacities to flexibly and cost effectively meet local 
  6.1   needs; and 
  6.2      (8) regional incentives that encourage joint planning and 
  6.3   actions between counties, area agencies on aging, and all other 
  6.4   critical actors to meet local needs through an integrated 
  6.5   informal system of care that is linked to formal systems. 
  6.6      Sec. 3.  [INSTRUCTION TO REVISOR.] 
  6.7      The revisor, in the next edition of Minnesota Statutes, 
  6.8   shall recodify section 256.9751 as section 256.9731, and make 
  6.9   any necessary changes in cross-references. 
  6.10     Sec. 4.  [APPROPRIATIONS.] 
  6.11     $1,160,000 in fiscal year 2001 is appropriated from the 
  6.12  general fund to the commissioner of human services to expand the 
  6.13  number of SAIL projects in the state and to implement the SAIL 
  6.14  initiatives required by section 2.  This money is in addition to 
  6.15  current base level funding for SAIL, and shall become part of 
  6.16  base level funding for SAIL for the biennium beginning July 1, 
  6.17  2001.
