  1.1                          A bill for an act
  1.2             relating to human services; requiring the commissioner 
  1.3             of human services to establish an advisory task force 
  1.4             on adult foster care rate-setting methods; requiring a 
  1.5             report to the legislature. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  [ADVISORY TASK FORCE ON ADULT FOSTER CARE RATE 
  1.8   SETTING.] 
  1.9      Subdivision 1.  [ESTABLISHMENT.] The commissioner of human 
  1.10  services shall establish an advisory task force on methods for 
  1.11  setting adult foster care reimbursement rates and other services 
  1.12  provided by a home care provider licensed by the department of 
  1.13  health that are provided in a building that is registered as a 
  1.14  housing with services establishment under Minnesota Statutes, 
  1.15  chapter 144D, and that provides 24-hour supervision under the 
  1.16  alternative care and elderly waiver programs.  Task force 
  1.17  membership shall consist of representatives of consumers, 
  1.18  counties, corporate and family adult foster care providers, 
  1.19  SAIL, and other services provided by a home care provider 
  1.20  licensed by the department of health that are provided in a 
  1.21  building that is registered as a housing with services 
  1.22  establishment under Minnesota Statutes, chapter 144D, and that 
  1.23  provides 24-hour supervision.  The commissioner shall appoint 
  1.24  task force members and provide technical assistance to the task 
  1.25  force.  The task force is governed by Minnesota Statutes, 
  2.1   section 15.059, subdivision 6. 
  2.2      Subd. 2.  [DUTIES AND REPORT.] The task force shall: 
  2.3      (1) examine current methods used by counties to set rates 
  2.4   for adult foster care and other services provided by a home care 
  2.5   provider licensed by the department of health that are provided 
  2.6   in a building that is registered as a housing with services 
  2.7   establishment under Minnesota Statutes, chapter 144D, and that 
  2.8   provides 24-hour supervision under the alternative care and 
  2.9   elderly waiver programs, and other rate setting options, 
  2.10  including, but not limited to, a statewide rate-setting method, 
  2.11  a statewide rate, and a statewide minimum rate; 
  2.12     (2) assess the degree to which current and potential 
  2.13  rate-setting options reflect client needs, best practices 
  2.14  including dignity, privacy, choice, least restrictive 
  2.15  alternative, and normalization, the number of people served, the 
  2.16  actual cost of providing services, and the impact of these 
  2.17  methods on rates charged to private-pay clients; 
  2.18     (3) analyze whether rate variation across counties affects 
  2.19  access to services and the quality of services; 
  2.20     (4) based upon this analysis, develop guidelines for 
  2.21  setting rates for adult foster care and other services provided 
  2.22  by a home care provider licensed by the department of health 
  2.23  that are provided in a building that is registered as a housing 
  2.24  with services establishment under Minnesota Statutes, chapter 
  2.25  144D, and that provides 24-hour supervision under the 
  2.26  alternative care and elderly waiver programs, and recommend a 
  2.27  rate-setting method based upon these guidelines that will ensure 
  2.28  adequate access to high-quality adult foster care and other 
  2.29  services provided by a home care provider licensed by the 
  2.30  department of health that are provided in a building that is 
  2.31  registered as a housing with services establishment under 
  2.32  Minnesota Statutes, chapter 144D, and that provides 24-hour 
  2.33  supervision in all areas of the state; and 
  2.34     (5) identify any legislative changes necessary to conform 
  2.35  to these guidelines and implement the recommended rate-setting 
  2.36  method. 
  3.1      Subd. 3.  [REPORT.] The task force shall present a written 
  3.2   report containing findings and recommendations to the 
  3.3   legislature by December 15, 2000, and shall comply with 
  3.4   Minnesota Statutes, sections 3.195 and 3.197.
